30 municipalities and authorizing creation of such

8 boundaries of an enterprise zone under
9 specified conditions; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Section 290.00695, Florida Statutes, is
15 created to read:
16 290.00695 Enterprise zone designation for Hernando
17 County or Hernando County and Brooksville.--Hernando County,
18 or Hernando County and the City of Brooksville jointly, may
19 apply to the Office of Tourism, Trade, and Economic
20 Development for designation of one enterprise zone within the
21 county, or within both the county and the city, which zone
22 encompasses an area up to 10 contiguous square miles. The
23 application must be submitted by December 31, 2001, and must
24 comply with the requirements of s. 290.0055. Notwithstanding
25 the provisions of s. 290.0065 limiting the total number of
26 enterprise zones designated and the number of enterprise zones
27 within a population category, the Office of Tourism, Trade,
28 and Economic Development may designate one enterprise zone
29 under this section. The Office of Tourism, Trade, and Economic
30 Development shall establish the initial effective date of the
31 enterprise zone designated under this section.

1 Section 2. Section 290.00696, Florida Statutes, is
2 created to read:
3 290.00696 Enterprise zone designation for Holmes
4 County.--Holmes County may apply to the Office of Tourism,
5 Trade, and Economic Development for designation of one
6 enterprise zone within an area in Holmes County. The
7 application must be submitted by December 31, 2001, and must
8 comply with the requirements of s. 290.0055. Notwithstanding
9 the provisions of s. 290.0065 limiting the total number of
10 enterprise zones designated and the number of enterprise zones
11 within a population category, the Office of Tourism, Trade,
12 and Economic Development may designate one enterprise zone
13 under this section. The Office of Tourism, Trade, and Economic
14 Development shall establish the initial effective date of the
15 enterprise zone designated pursuant to this section.
16 Section 3. Section 290.00697, Florida Statutes, is
17 created to read:
18 290.00697 Enterprise zone designation for Calhoun
19 County.--Calhoun County may apply to the Office of Tourism,
20 Trade, and Economic Development for designation of one
21 enterprise zone within an area in Calhoun County. The
22 application must be submitted by December 31, 2001, and must
23 comply with the requirements of s. 290.0055, except subsection
24 (3) thereof. Notwithstanding the provisions of s. 290.0065
25 limiting the total number of enterprise zones designated and
26 the number of enterprise zones within a population category,
27 the Office of Tourism, Trade, and Economic Development may
28 designate one enterprise zone under this section. The Office
29 of Tourism, Trade, and Economic Development shall establish
30 the initial effective date of the enterprise zone designated
31 pursuant to this section.

1 Section 4. Section 290.00698, Florida Statutes, is
2 created to read:
3 290.00698 Enterprise zone designation for Okaloosa
4 County.--Okaloosa County may apply to the Office of Tourism,
5 Trade, and Economic Development for designation of one
6 enterprise zone within an area in Okaloosa County, which zone
7 encompasses an area up to 6 square miles. The application
8 must be submitted by December 31, 2001, and must comply with
9 the requirements of s. 290.0055, except subsection (3)
10 thereof. Notwithstanding the provisions of s. 290.0065
11 limiting the total number of enterprise zones designated and
12 the number of enterprise zones within a population category,
13 the Office of Tourism, Trade, and Economic Development may
14 designate one enterprise zone under this section. The Office
15 of Tourism, Trade, and Economic Development shall establish
16 the initial effective date of the enterprise zone designated
17 pursuant to this section.
18 Section 5. Section 290.00694, Florida Statutes, is
19 created to read:
20 290.00694 Enterprise zone designation for Sarasota
21 County or Sarasota County and Sarasota.--Sarasota County, or
22 Sarasota County and the City of Sarasota jointly, may apply to
23 the Office of Tourism, Trade, and Economic Development for
24 designation of one enterprise zone within the county, or
25 within both the county and the municipality, which zone
26 encompasses an area that is south of the north county line,
27 west of Tuttle Avenue, north of 10th Street, and east of U.S.
28 Highway 41. The application must be submitted by December 31,
29 2001, and must comply with the requirements of s. 290.0055.
30 Notwithstanding the provisions of s. 290.0065 limiting the
31 total number of enterprise zones designated and the number of

1 enterprise zones within a population category, the Office of
2 Tourism, Trade, and Economic Development may designate one
3 enterprise zone under this section. The Office of Tourism,
4 Trade, and Economic Development shall establish the initial
5 effective date of the enterprise zone designated under this
6 section.
7 Section 6. Enterprise zone designation for
8 Hillsborough County.--Hillsborough County may apply to the
9 Office of Tourism, Trade, and Economic Development for
10 designation of one enterprise zone within the county, which
11 zone encompasses a high-crime, low-income, high-unemployment
12 area that is north of Fowler Avenue, south of Bearss Avenue,
13 east of Florida Avenue, west of Bruce B. Downs Boulevard, near
14 the University of South Florida, adjacent to University Square
15 Mall, north of a major theme park, an area that has been
16 designated a federal Weed & Seed target area, and a Community
17 Development Block Grant (CDBG) target area and that houses an
18 active public/private 501(c)(3) community development
19 corporation working to improve the area. The application must
20 be submitted by December 31, 2002, and must comply with the
21 requirements of section 290.0055, Florida Statutes.
22 Notwithstanding the provisions of section 290.0065, Florida
23 Statutes, limiting the total number of enterprise zones
24 designated and the number of enterprise zones within a
25 population category, the Office of Tourism, Trade, and
26 Economic Development may designate one enterprise zone under
27 this section. The Office of Tourism, Trade, and Economic
28 Development shall establish the initial effective date of the
29 enterprise zone designated under this section.
30 Section 7. Section 290.00555, Florida Statutes, is
31 amended to read:

1 290.00555 Satellite enterprise zones.--Before December
2 31, 1999, Any municipality an area of which has previously
3 received designation as an enterprise zone in the population
4 category described in s. 290.0065(3)(a)3. may create a
5 satellite enterprise zone not exceeding 1.5 square miles in
6 area outside of and, notwithstanding anything contained in s.
7 290.0055(4), or any other law, in addition to the previously
8 designated enterprise zone boundaries. The Office of Tourism,
9 Trade, and Economic Development shall amend the boundaries of
10 the areas previously designated by any such municipality as
11 enterprise zones upon receipt of a resolution adopted by the
12 municipality describing the satellite enterprise zone areas,
13 as long as the additional areas are consistent with the
14 categories, criteria, and limitations imposed by s. 290.0055.
15 However, the requirements imposed by s. 290.0055(4)(d) do not
16 apply to such satellite enterprise zone areas.
17 Section 8. Satellite enterprise zones may be created
18 pursuant to section 290.00555, Florida Statutes, effective
19 retroactively to December 31, 1999. Resolutions adopted to
20 create satellite enterprise zones under this section must be
21 submitted to the Office of Tourism, Trade, and Economic
22 Development no later than August 1, 2001. The Office of
23 Tourism, Trade, and Economic Development must amend the
24 boundaries of previously designated enterprise zones to create
25 eligible satellite enterprise zones no later than September 1,
26 2001. Notwithstanding the time limitations contained in
27 chapter 212, Florida Statutes, a business in a satellite
28 enterprise zone designated under this section which was
29 eligible to receive tax incentives pursuant to sections
30 212.08(5)(g) and (h) and 212.096, Florida Statutes, during the
31 period beginning December 31, 1999, and ending on the date of

1 the creation of the satellite enterprise zone must submit an
2 application for the tax incentives by December 1, 2001. All
3 other requirements of the enterprise zone program apply to
4 such a business.
5 Section 9. Notwithstanding any provisions of law to
6 the contrary, the governing body of an inland county with a
7 state-designated enterprise zone and a population greater than
8 500,000 may apply to the Office of Tourism, Trade, and
9 Economic Development to amend the boundaries of one
10 noncontiguous area of an enterprise zone. The office shall
11 approve the application as long as the amended area does not
12 exceed 4 square miles and is consistent with the categories,
13 criteria, and limitations imposed by section 290.0055, Florida
14 Statutes, upon the establishment of such enterprise zone. The
15 enterprise zone boundary-amendment application must be
16 received before December 31, 2001.
17 Section 10. Subsection (12) is added to section
18 290.0065, Florida Statutes, to read:
19 290.0065 State designation of enterprise zones.--
20 (12) Before June 1, 2002, the governing body of a
21 municipality that is located within a county having a
22 population of less than 225,000 and in which an enterprise
23 zone designated under subparagraph (3)(a)2. is located may
24 apply to the Office of Tourism, Trade, and Economic
25 Development to change the boundaries of the enterprise zone.
26 The Office of Tourism, Trade, and Economic Development shall
27 approve the application if the boundary change does not
28 increase the overall size of the enterprise zone and if any
29 territory added to the enterprise zone as a result of the
30 boundary change is contiguous to the remaining area of the
31 existing enterprise zone.

1 Section 11. This act shall take effect upon becoming a
2 law.

7 In addition to Sarasota County or Sarasota County and the City
of Sarasota, and satellite enterprise zones, this committee
8 substitute authorizes the creation or expansion of enterprise
zones located in the following local governments:

- Hernando County or Hernando County and the City of
10 Brooksville jointly;
11 - Holmes County;
12 - Calhoun County;
13 - Okaloosa County;
14 - Hillsborough County;
15 - Orange County; and
16 - the City of Gainesville
