18 Section 2. Section 316.1923, Florida Statutes, is
19 created to read:
20 316.1923 Aggressive careless driving--Aggressive
21 careless driving is defined as committing two or more of the
22 following acts simultaneously or in succession:
23 (1) Exceeding the posted speed as defined in s.
24 322.27(3)(d)5.b.
25 (2) Unsafely or improperly changing lanes as defined
26 in s. 316.085.
27 (3) Following another vehicle too closely as defined
28 in s. 316.0895(1).
29 (4) Failing to yield the right-of-way as defined in s.
30 316.079, s. 316.0815, or s. 316.123.
31 (5) Improperly passing as defined in s. 316.083, s.

2 (6) Violating traffic control and signal devices as
3 defined in s. 316.074 and s. 316.075.
4 Section 3. Section 316.650(1)(a), is amended to read:
5 316.650 Traffic citations.--
6 (1)(a) The department shall prepare, and supply to
7 every traffic enforcement agency in this state, an appropriate
8 form traffic citation containing a notice to appear (which
9 shall be issued in prenumbered books with citations in
10 quintuplicate) and meeting the requirements of this chapter or
11 any laws of this state regulating traffic, which form shall be
12 consistent with the state traffic court rules and the
13 procedures established by the department. Upon all future
14 printings of the traffic citation, the form shall include a
15 special box which is to be checked by the law enforcement
16 officer when the officer believes that the traffic violation
17 and/or crash was caused due to aggressive careless driving as
18 defined in s. 316.1923.
19 Section 4. A report shall be prepared and delivered
20 to the Speaker of the House and the President of the Senate no
21 later than December 1, 2002 setting forth the numbers of
22 incidents of aggressive careless driving in Florida.
23 Section 5. This act shall take effect upon becoming
24 a law.

5 and Motor Vehicles revise the uniform traffic
6 citation upon future printings, to include a
7 special check-off box for law enforcement
8 officers to use to indicate aggressive careless
9 driving; requiring a report to the Legislature
10 on the number of aggressive careless driving
11 incidents;
