2 An act relating to organ transplantation;

6 programs; requiring the task force to study and

8 issuance of certificates of need for such
9 programs and funding for organ transplantation;
10 providing a date for the task force to report
11 to the Governor and the Legislature; providing
12 an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. (1)(a) The Agency for Health Care
17 Administration shall create an Organ Transplant Task Force
18 within the Agency for Health Care Administration, which task
19 force must be funded by existing agency funds.
20 (b) Task force participants shall be responsible for
21 only the expenses that they generate individually through
22 participation. The agency shall be responsible for expenses
23 incidental to the production of any required data or reports.
24 (2) The task force shall consist of up to 15 members.
25 The task force chairperson shall be selected by majority vote
26 of a quorum present. Eight members shall constitute a quorum.
27 The membership shall include, but not be limited to, a balance
28 of members representing the Agency for Health Care
29 Administration, health care facilities that have existing
30 organ transplantation programs, individual organ transplant
31 health care practitioners, pediatric organ transplantation

1 programs, organ procurement agencies, and organ transplant
2 recipients or family members.
3 (3) The task force shall meet for the purpose of
4 studying and making recommendations regarding current and
5 future supply of organs in relation to the number of existing
6 organ transplantation programs and the future necessity of the
7 issuance of a certificate of need for proposed organ
8 transplantation programs. At a minimum, the task force shall
9 submit a report to the Legislature which includes a summary of
10 the method of allocation and distribution of organs; a list of
11 facilities performing multiple organ transplants and the
12 number being performed; the number of Medicaid and charity
13 care patients who have received organ transplants by existing
14 organ transplant programs; suggested mechanisms for funding
15 organ transplants, which shall include, but need not limited
16 to, an organ transplant trust fund for the treatment of
17 Medicaid and charity patients; the impact of trends in health
18 care delivery and financing on organ transplantation; and the
19 number of certificates of need applications reviewed by the
20 Agency for Health Care Administration in the last 5 years,
21 including the number approved or denied and the number
22 litigated.
23 (4) The task force shall meet at the call of the
24 chairperson. The task force shall submit a report to the
25 Governor, the President of the Senate, and the Speaker of the
26 House of Representatives by January 15, 2002. The task force
27 is abolished effective December 31, 2002.
28 Section 2. This act shall take effect July 1, 2001.
