  1                      A bill to be entitled

  2         An act relating to drug-free workplaces;

  3         amending s. 440.102, F.S.; requiring certain

  4         contractors to implement a drug-free workplace

  5         program under certain circumstances; providing

  6         an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Subsection (15) is added to section

11  440.102, Florida Statutes, to read:

12         440.102  Drug-free workplace program requirements.--The

13  following provisions apply to a drug-free workplace program

14  implemented pursuant to law or to rules adopted by the Agency

15  for Health Care Administration:

16         (15)  STATE CONSTRUCTION CONTRACTS.--Each construction

17  contractor, as regulated under part I of chapter 489, and each

18  electrical contractor and alarm system contractor, as

19  regulated under part II of chapter 489, who contracts to

20  perform construction work under a state contract for

21  educational facilities as governed by chapter 235, public

22  property and publicly owned buildings as governed by chapter

23  255, or state correctional facilities as governed by chapter

24  944 shall implement a drug-free workplace program under this

25  section.

26         Section 2.  This act shall take effect October 1, 2001.

  1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
  2                              SB 718

  4  The committee substitute clarifies that certain construction
    contractors, electrical contractors, and alarm system
  5  contractors are required to implement a drug-free workplace
    program. The committee substitute also clarifies that state
  6  contracts for educational facilities, public property and
    publicly owned buildings, and state correctional facilities
  7  are the types of state contracts to which the committee
    substitute applies.
