  1                      A bill to be entitled

  2         An act relating to traffic control programs;

  3         amending s. 318.21, F.S.; authorizing

  4         municipalities and counties to impose a

  5         surcharge on civil penalties for traffic

  6         infractions to fund traffic control and safety

  7         programs; prohibiting the levying of said

  8         surcharge on traffic infractions occurring on

  9         interstate highways; requiring the proceeds

10         from such surcharge to be deposited in the

11         Community Traffic Safety Trust Fund; providing

12         for distribution of such funds; providing an

13         exception; providing an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16

17         Section 1.  Subsection (13) is added to section 318.21,

18  Florida Statutes, to read:

19         318.21  Disposition of civil penalties by county

20  courts.--All civil penalties received by a county court

21  pursuant to the provisions of this chapter shall be

22  distributed and paid monthly as follows:

23         (13)(a)  A municipality or county may, by majority vote

24  of the governing board of the municipality or county, impose a

25  surcharge on the amount of civil penalties required under s.

26  318.18 for traffic infractions for the purposes of funding

27  residential traffic calming programs, crossing guards in

28  school zones, and police monitoring in school zones. The

29  surcharge may not be levied on traffic infractions occurring

30  on interstate highways. The surcharge must be authorized by

  1  ordinance requiring public hearings and shall not be more than

  2  $5.

  3         (b)  The proceeds of this surcharge must be placed in a

  4  trust fund established by the governing body of the

  5  municipality or county called the Community Traffic Safety

  6  Trust Fund.  Funds collected from this surcharge must be

  7  distributed quarterly to fund residential traffic calming

  8  programs, crossing guards in school zones, and police

  9  monitoring in school zones.

10         (c)  This subsection shall not apply to counties with a

11  population of less than 1 million.

12         Section 2.  This act shall take effect upon becoming a

13  law.
