  1                      A bill to be entitled

  2         An act relating to workers' compensation;

  3         amending s. 440.092, F.S.; revising provisions

  4         relating to special requirements for

  5         compensability under the Workers' Compensation

  6         Law; providing that, in specified

  7         circumstances, certain law enforcement

  8         officers, when they are in an official law

  9         enforcement vehicle, are considered to be

10         acting in the course of their employment;

11         providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14

15         Section 1.  Subsection (2) of section 440.092, Florida

16  Statutes, is amended to read:

17         440.092  Special requirements for compensability;

18  deviation from employment; subsequent intervening accidents.--

19         (2)  GOING OR COMING.--An injury suffered while going

20  to or coming from work is not an injury arising out of and in

21  the course of employment whether or not the employer provided

22  transportation if such means of transportation was available

23  for the exclusive personal use by the employee, unless the

24  employee was engaged in a special errand or mission for the

25  employer. Notwithstanding any provision of law to the

26  contrary, an officer, as defined in s. 943.10(1), s.

27  943.10(2), or s. 943.10(3), who, during the officer's assigned

28  work schedule or while going to or coming from work, is in a

29  marked or unmarked official law enforcement vehicle is

30  considered to be engaged in a special errand or mission for

31  his or her employer.

  1         Section 2.  This act shall take effect upon becoming a

  2  law.

  5                          SENATE SUMMARY

  6    For purposes of compensability under the Workers'
      Compensation Law, provides that certain law enforcement
  7    officers are considered to be acting in the course of
      their employment while they are engaged in their
  8    respective assigned work schedules or are going to or
      coming from work in an official law enforcement vehicle.
