13         Amendment (with title amendment) 
14         On page 3, between lines 13 & 14,

16  insert:  
17         Section 4.  Section 409.9205, Florida Statutes, is
18  amended to read:
19         409.9205  Medicaid Fraud Control Unit; law enforcement
20  officers.--
21         (1)  Except as provided in s. 110.205, all positions in
22  the Medicaid Fraud Control Unit of the Department of Legal
23  Affairs are hereby transferred to the Career Service System.
24         (2)  All investigators employed by the Medicaid Fraud
25  Control Unit who have been certified under s. 943.1395 are law
26  enforcement officers of the state.  Such investigators have
27  the authority to conduct criminal investigations, bear arms,
28  make arrests, and apply for, serve, and execute search
29  warrants, arrest warrants, capias, and other process
30  throughout the state pertaining to Medicaid fraud as described
31  in this chapter.  The Attorney General shall provide

 1  reasonable notice of criminal investigations conducted by the
 2  Medicaid Fraud Control Unit to, and coordinate those
 3  investigations with, the sheriffs of the respective counties.
 4  Investigators employed by the Medicaid Fraud Control Unit are
 5  not eligible for membership in the Special Risk Class of the
 6  Florida Retirement System under s. 121.0515.
