2 An act relating to the disposition of traffic
3 fines; amending s. 318.21, F.S.; revising
4 requirements for the use of funds collected
5 from moving traffic violations; requiring that
6 such funds be used to fund automation for law
7 enforcement agencies in certain counties in
8 which a municipality has been declared to be in
9 a state of financial emergency; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Subsection (10) of section 318.21, Florida
15 Statutes, is amended to read:
16 318.21 Disposition of civil penalties by county
17 courts.--All civil penalties received by a county court
18 pursuant to the provisions of this chapter shall be
19 distributed and paid monthly as follows:
20 (10) Twelve dollars and fifty cents from each moving
21 traffic violation must be used by the county to fund that
22 county's participation in an intergovernmental radio
23 communication program approved by the Department of Management
24 Services. If there is a municipality within the county that
25 has been in a state of financial emergency pursuant to s.
26 218.503 during the preceding 5 years, has had a financial
27 emergencies board established, regardless of whether the board
28 is currently in existence, and maintains a radio-communication
29 program independent of the county, funds collected must be
30 used to fund local law enforcement automation and must be
31 distributed to that municipality. If the county is not

1 participating in such a program, funds collected must be used
2 to fund local law enforcement automation and must be
3 distributed to the municipality or the special improvement
4 district in which the violation occurred or to the county if
5 the violation occurred within the unincorporated area of the
6 county.
7 Section 2. This act shall take effect July 1, 2001.
