1 House Joint Resolution
2 A joint resolution proposing an amendment to
3 Section 5 of Article XI of the State
4 Constitution relating to approval of
5 constitutional amendments.

7 Be It Resolved by the Legislature of the State of Florida:

9 That the amendment to Section 5 of Article XI of the
10 State Constitution set forth below is agreed to and shall be
11 submitted to the electors of Florida for approval or rejection
12 at the general election to be held in November 2002:
13 SECTION 5. Amendment or revision election.--
14 (a) A proposed amendment to or revision of this
15 constitution, or any part of it, shall be submitted to the
16 electors at the next general election held more than ninety
17 days after the joint resolution, initiative petition or report
18 of revision commission, constitutional convention or taxation
19 and budget reform commission proposing it is filed with the
20 custodian of state records, unless, pursuant to law enacted by
21 the affirmative vote of three-fourths of the membership of
22 each house of the legislature and limited to a single
23 amendment or revision, it is submitted at an earlier special
24 election held more than ninety days after such filing.
25 (b) Once in the tenth week, and once in the sixth week
26 immediately preceding the week in which the election is held,
27 the proposed amendment or revision, with notice of the date of
28 election at which it will be submitted to the electors, shall
29 be published in one newspaper of general circulation in each
30 county in which a newspaper is published.

1 (c) If the proposed amendment or revision is approved
2 by vote of at least two-thirds of the electors voting on the
3 proposed amendment or revision, it shall be effective as an
4 amendment to or revision of the constitution of the state on
5 the first Tuesday after the first Monday in January following
6 the election, or on such other date as may be specified in the
7 amendment or revision.
8 BE IT FURTHER RESOLVED that in accordance with the
9 requirements of section 101.161, Florida Statutes, the title
10 and substance of the amendment proposed herein shall appear on
11 the ballot as follows:
12 APPROVAL OF CONSTITUTIONAL AMENDMENTS
13 Requires approval by two-thirds, rather than a simple
14 majority, of the electors voting on a proposed constitutional
15 amendment.
