1 A bill to be entitled
2 An act relating to prevention and control of
3 communicable diseases; amending s. 381.003,
4 F.S.; requiring the Department of Health to
5 adopt certain standards applicable to all
6 public-sector employers; requiring the
7 compilation and maintenance of certain
8 information by the department for use by
9 employers; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (3) is added to section 381.003,
14 Florida Statutes, to read:
15 381.003 Communicable disease and AIDS prevention and
16 control.--
17 (3) The department shall by rule adopt the
18 blood-borne-pathogen standard set forth in subpart Z of 29
19 C.F.R. part 1910, as amended by Pub. L. No. 106-430, which
20 shall be applicable to all public-sector employers. The
21 department shall compile and maintain a list of existing
22 needleless systems and sharps with engineered sharps-injury
23 protection that shall be available to assist employers,
24 including the department and the Department of Corrections, in
25 complying with the applicable requirements of the
26 blood-borne-pathogen standard. The list may be developed from
27 existing sources of information, including, but not limited
28 to, the United States Food and Drug Administration, the
29 Centers for Disease Control and Prevention, the Occupational
30 Safety and Health Administration, and the United States
31 Department of Veterans Affairs.

1 Section 2. This act shall take effect July 1, 2001.

3 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
4 Senate Bill 828

6 The Committee Substitute requires the Department of Health to
adopt, by rule the blood-borne-pathogen standard set forth in
7 the federal law, which shall become applicable to all public
sector employers. The Department of Health must compile and
8 maintain a list of existing needleless systems and sharps with
engineered sharps injury protection that must be available to
9 assist employers, including the Department of Health and the
Department of Corrections, in complying with the applicable
10 requirements of the blood-borne pathogen standard. The list
may be developed from existing sources of information.
