1 A bill to be entitled
2 An act relating to the City of Pompano Beach,
3 Broward County; amending chapter 2000-476, Laws
4 of Florida; providing for an interlocal
5 agreement which would include provisions to
6 jointly fund program infrastructure
7 improvements between the City of Pompano Beach
8 and Broward County, provided the city is not
9 limited in its ability to receive anticipated
10 utility taxes, franchise fees, or other fees;
11 providing that calculations of population
12 census of the City of Pompano Beach begin with
13 the fiscal year 2000 and include all new
14 residents added to the city as a result of
15 chapter 2000-476, Laws of Florida; providing
16 for retroactive application to September 15,
17 2000; providing an effective date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Section 3 of chapter 2000-476, Laws of
22 Florida, is amended to read:
23 Section 3. An interlocal agreement shall be developed
24 between the governing bodies of Broward County and the
25 annexing city and executed prior to the effective date of the
26 annexation. The agreement shall include a financially feasible
27 plan for transitioning county services, buildings,
28 infrastructure, waterways, roads and rights-of-way, and
29 employees, including provisions to jointly fund programmed
30 infrastructure improvements, provided that the city is not
31 limited in its ability to receive anticipated utility taxes,

1 utility franchise fees, or other franchise fees and provisions
2 for Broward County to continue to receive certain revenues
3 generated by the Cresthaven Area until the completion of
4 programmed infrastructure improvements, as appropriate.
5 Section 2. A new section 7 is added to chapter
6 2000-476, Laws of Florida, to read:
7 Section 7. Notwithstanding the provisions of section
8 186.901, Florida Statutes, to the contrary, for the sole
9 purpose of calculating the revenues attributable to utility
10 taxes, utility franchise fees, or other franchise fees, the
11 calculation of the total population census of the City of
12 Pompano Beach, beginning with fiscal year 2000, shall include
13 all of the new residents added to the city as a result of the
14 enactment of this act.
15 Section 3. The amendments to chapter 2000-476, Laws of
16 Florida, as provided in sections 1 and 2 of this act, shall be
17 retroactively applied to September 15, 2000.
18 Section 4. This act shall take effect upon becoming a
19 law.
