1 A bill to be entitled
2 An act relating to solid waste management
3 facilities; amending s. 403.707, F.S.;
4 requiring an applicant for a permit to
5 construct or modify a solid waste management
6 facility to notify the local government of the
7 filing of application; requiring publishing of
8 the application; providing requirements with
9 respect thereto; amending s. 403.71851, F.S.;
10 providing for electronics recycling grants;
11 providing that grant funding shall be used for
12 certain demonstration projects; providing for
13 the Department of Environmental Protection to
14 conduct a comprehensive review of certain waste
15 reduction and recycling goals and other related
16 legislative requirements; providing that the
17 department must issue a report; providing an
18 effective date.

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. Subsection (14) is added to section
23 403.707, Florida Statutes, to read:
24 403.707 Permits.--
25 (14) Before or on the same day of filing with the
26 department of an application for a permit to construct or
27 substantially modify a solid waste management facility, the
28 applicant shall notify the local government having
29 jurisdiction over the facility of the filing of the
30 application. The applicant also shall publish notice of the
31 filing of the application in a newspaper of general

1 circulation in the area where the facility will be located.
2 Notice shall be given and published in accordance with
3 applicable department rules. The department shall not issue
4 the requested permit until the applicant has provided the
5 department with proof that the notices required by this
6 subsection have been given. Issuance of a permit does not
7 relieve an applicant from compliance with local zoning or
8 land-use ordinances, or with any other laws, rules, or
9 ordinances.
10 Section 2. Section 403.71851, Florida Statutes, is
11 amended to read:
12 403.71851 Electronic recycling Lead-containing
13 materials grants.--The Department of Environmental Protection
14 is authorized to use funds from the Solid Waste Management
15 Trust Fund as grants to Florida-based businesses with 5 or
16 more years' experience in electronics recycling which that
17 recycle electronics such as commercial telephone switching
18 equipment, computers, televisions, lead-acid batteries and
19 other lead-containing materials, including products such as
20 televisions and computer monitors, and other products that
21 utilize lead-containing cathode ray tubes. This incentive
22 funding shall may be used for demonstration projects with one
23 or more counties for countywide comprehensive electronics
24 recycling that provides service to the private sector,
25 nonprofit organizations, governmental agencies, and the
26 residential sector. This funding may also be used for grants
27 to counties to develop methods for collecting and transporting
28 electronics to be recycled, provided such methods are
29 comprehensive in nature research and development in methods to
30 recover and recycle lead from the environment; for innovative
31 technologies and equipment to process and recycle

1 lead-containing materials; and for establishing an
2 infrastructure to collect and transport lead-containing
3 material to Florida-based recycling businesses.
4 Section 3. The Department of Environmental Protection
5 shall conduct a comprehensive review of the waste reduction
6 and recycling goals set out in this section and other
7 legislative requirements in view of reduced available funding
8 for these purposes. The review shall include, but is not
9 limited to, the appropriateness of maintaining, extending, or
10 revising the goals; the effectiveness of current programs for
11 meeting the goals; the role of Keep Florida Beautiful, Inc.;
12 the need to continue those programs; alternative techniques
13 for improving those programs; and alternative strategies for
14 meeting the needs of the programs. The department shall
15 consult with persons knowledgeable about recycling and waste
16 reduction, including, but not limited to, representatives of
17 local government, the private recycling industry, and the
18 private waste management industry. The department shall issue
19 its report and recommendations to the Governor, the President
20 of the Senate, and the Speaker of the House of Representatives
21 by September 30, 2001.
22 Section 4. This act shall take effect October 1, 2001.

4 The Committee Substitute:
5 Requires an applicant for a permit for a solid waste
management facility to notify the local government with
6 jurisdiction over the facility before or on the same day of
the filing of the permit application with the Department of
7 Environmental Protection and to publish newspaper notice of
the filing of the application in a newspaper of general
8 circulation in the area where the facility will be located.
The CS prohibits the department from issuing the permit until
9 the notice requirements have been satisfied rather than
tolling the permit processing time periods until 14 days after
10 the information has been submitted.
11 Amends s. 403.71851, F.S., to authorize the department to use
solid waste management funds to make grants to counties for
12 demonstration projects which encourage the recycling of
electronic equipment.

Directs the Department of Environmental Protection to review
14 waste reduction and recycling programs authorized by s.
403.706, F.S., in light of reduced funding, and to issue a
15 report to the Governor, President of the Senate and Speaker of
the House of Representatives by September 30,2001 making
16 recommendations as to how the recycling goals, grants and
other requirements should be changed because of the reduced
17 state funding.
