18         Section 1.  Section 2 of chapter 63-609, Laws of
19  Florida, is amended to read:
20         Section 2.  Provisions of Chapter 298, Florida
21  Statutes, Made Applicable.   The Sunshine Drainage District, a
22  an independent special district and public corporation of this
23  state, created under Chapter 298, Florida Statutes, shall be
24  governed by provisions of the general drainage laws of Florida
25  applicable to drainage districts or sub-drainage districts
26  which are embodied in Chapter 298, Florida Statutes, and all
27  of the laws amendatory thereof, now existing or hereinafter
28  enacted, so far as not inconsistent with this act or any
29  hereinafter enacted, so far as not inconsistent with this act
30  or any subsequent special acts relating to Sunshine Drainage
31  District except those portions of sections 298.11, 298.12, and

HOUSE AMENDMENT Bill No. HB 837 Barcode 050343 Amendment No. 01 (for drafter's use only) 1 298.14, Florida Statutes, pertaining to how the members of the 2 board of supervisors are elected and to board of supervisors 3 meetings, which shall be as provided for herein. In lieu 4 thereof, the following provisions shall apply to the 5 district:. 6 (1) The board of supervisors shall consist of five 7 elected members. The five candidates receiving the highest 8 number of votes cast at a special election conducted by the 9 Supervisor of Elections shall be elected to the board. Elected 10 members of the board of supervisors shall be residents of the 11 district. 12 (2) Commencing upon the expiration of the terms of the 13 existing board members, all subsequent board members shall 14 meet the requirements provided for herein and shall be elected 15 as provided for herein. Existing board members' terms shall be 16 extended to November of the year in which their term expires. 17 In November 2002, the two new board members shall be selected 18 or elected as provided for herein. Board members to be elected 19 shall be elected at an election conducted by the Supervisor of 20 Elections on the first Tuesday in November of the year when 21 the board member's term expires. The costs of such elections 22 shall be paid for by the district. 23 (3) The board shall establish a regular meeting date 24 each month and shall meet no less than one time each month. 25 However, the board may decide by majority vote to take 1 month 26 off from meetings each year for a vacation. Meetings of the 27 board shall be held in a public place, and shall be held in 28 accordance with the requirements of chapter 286, Florida 29 Statutes. A majority of the members of the board of 30 supervisors shall constitute a quorum. In case any one or more of the sections or 6 provisions of this act or the application of such sections or 7 provisions to any situation, circumstance, or person shall for 8 any reason be held to be unconstitutional, such 9 unconstitutionality shall not affect any other sections or 10 provisions of this act or the applications of such sections or 11 provisions to any other situation, circumstance, or person, 12 and it is intended that this law shall be construed and 13 applied as if such section or provision had not been included 14 herein for any unconstitutional application. 15 Section 3. In the event of a conflict between the 16 provisions of this act and the provisions of any other act, 17 the provisions of this act shall control to the extent of such 18 conflict. 19 Section 4.
