  2         An act relating to law enforcement; amending s.

  3         943.1758, F.S.; providing that instruction in

  4         interpersonal skills relating to diverse

  5         populations shall consist of a module developed

  6         by the Criminal Justice Standards and Training

  7         Commission on the topic of discriminatory

  8         profiling; amending ss. 30.15 and 166.0493,

  9         F.S.; requiring sheriffs and municipal law

10         enforcement agencies to incorporate antiracial

11         or other antidiscriminatory profiling policies

12         into their policies and practices; providing

13         guidelines and requirements for such policies;

14         providing an effective date.

16  Be It Enacted by the Legislature of the State of Florida:

17  

18         Section 1.  Section 943.1758, Florida Statutes, is

19  amended to read:

20         943.1758  Curriculum revision for diverse populations;

21  skills training.--

22         (1)  The Criminal Justice Standards and Training

23  Commission shall revise its standards and training for basic

24  recruits and its requirements for continued employment by

25  integrating instructions on interpersonal skills relating to

26  diverse populations into the criminal justice standards and

27  training curriculum. The curriculum shall include standardized

28  proficiency instruction relating to high-risk and critical

29  tasks which include, but are not limited to, stops, use of

30  force and domination, and other areas of interaction between

31  officers and members of diverse populations.

  1         (2)  The commission shall develop and implement, as

  2  part of its instructor training programs, standardized

  3  instruction in the subject of interpersonal skills relating to

  4  diverse populations.

  5         (3)  Culturally sensitive lesson plans, up-to-date

  6  videotapes, and other demonstrative aids developed for use in

  7  diverse population-related training shall be used as

  8  instructional materials.

  9         (4)  By October 1, 2001, the instruction in the subject

10  of interpersonal skills relating to diverse populations shall

11  consist of a module developed by the commission on the topic

12  of discriminatory profiling.

13         Section 2.  Subsection (3) is added to section 30.15,

14  Florida Statutes, to read:

15         30.15  Powers, duties, and obligations.--

16         (3)  On or before January 1, 2002, every sheriff shall

17  incorporate an antiracial or other antidiscriminatory

18  profiling policy into the sheriff's policies and practices,

19  utilizing the Florida Police Chiefs Association Model Policy

20  as a guide. Antiprofiling policies shall include the elements

21  of definitions, traffic stop procedures, community education

22  and awareness efforts, and policies for the handling of

23  complaints from the public.

24         Section 3.  Section 166.0493, Florida Statutes, is

25  created to read:

26         166.0493  Powers, duties, and obligations of municipal

27  law enforcement agencies.--On or before January 1, 2002, every

28  municipal law enforcement agency shall incorporate an

29  antiracial or other antidiscriminatory profiling policy into

30  the agency's policies and practices, utilizing the Florida

31  Police Chiefs Association Model Policy as a guide.

  1  Antiprofiling policies shall include the elements of

  2  definitions, traffic stop procedures, community education and

  3  awareness efforts, and policies for the handling of complaints

  4  from the public.

  5         Section 4.  This act shall take effect upon becoming a

  6  law.
