1 A bill to be entitled
2 An act relating to the West Lauderdale Water
3 Control District; repealing section 9.02 of
4 chapter 96-472, Laws of Florida; providing for
5 the dissolution of the West Lauderdale Water
6 Control District on a specified date; providing
7 for the assumption of its assets and
8 liabilities by the Bonaventure Development
9 District; providing for continuance of certain
10 contracts; providing for limitations and
11 restrictions on the use of the assets and
12 revenues of the West Lauderdale Water Control
13 District; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. Section 9.02 of the City of Weston Charter,
18 as created by chapter 96-472, Laws of Florida, is repealed.
19 Section 2. The West Lauderdale Water Control District,
20 created as an independent water control district, pursuant to
21 chapter 298, Florida Statutes, by Circuit Court Decree, 17th
22 Judicial Circuit, dated May 17, 1969, is dissolved as of 12
23 a.m. on July 1, 2001.
24 Section 3. Upon dissolution of the West Lauderdale
25 Water Control District, all powers, duties, responsibilities,
26 obligations, assets, revenues, and functions of the district
27 shall be transferred to and performed by the Bonaventure
28 Development District, as created by Weston Ordinance 98-61.
29 Section 4. Upon dissolution, the West Lauderdale Water
30 Control District shall deliver all books and records of the

1 district and pay over all funds and moneys of the district to
2 the Bonaventure Development District.
3 Section 5. Upon dissolution of the West Lauderdale
4 Water Control District, the Bonaventure Development District
5 shall assume all liabilities of the West Lauderdale Water
6 Control District both known and unknown at the time of
7 dissolution. All assets, including real, personal, and
8 intangible property, belonging to the West Lauderdale Water
9 Control District and all rights and interest therein and all
10 easements and rights-of-way belonging to the district shall
11 become the assets and property of the Bonaventure Development
12 District.
13 Section 6. All contracts to which the West Lauderdale
14 Water Control District is a party shall remain in full force
15 and effect for the period provided in the contract, except
16 that the board of the Bonaventure Development District shall
17 be substituted for the district as a party to such contracts.
18 The board of the Bonaventure Development District shall be
19 entitled to all benefits and subject to all liabilities under
20 contracts and shall have the same rights and liabilities to
21 perform, to require performance of, and to modify or terminate
22 such contracts as the district.
23 Section 7. All moneys and other revenues accruing from
24 the operations, facilities, or assets transferred to the
25 Bonaventure Development District by the West Lauderdale Water
26 Control District may be used by the Bonaventure Development
27 District only for purposes relating to drainage within the
28 district as authorized by law, and subject to the same
29 restrictions imposed by law, for which such moneys and
30 revenues could have been used by the West Lauderdale Water
31 Control District had they not been dissolved and their assets

1 and liabilities not been transferred to the Bonaventure
2 Development District by this act.
3 Section 8. This act shall take effect upon becoming a
4 law.
