  2         An act relating to the Hillsborough County

  3         Hospital Authority; amending subsection (10) of

  4         section 5, relating to facilitating an employee

  5         advisory committee, subsection (2) of section

  6         6, relating to an employee advisory committee,

  7         subsection (3) of section 7, relating to

  8         reimbursement for services to indigents, and

  9         section 9, relating to parking and office

10         facilities of chapter 96-449, Laws of Florida;

11         providing that those subsections and section

12         are applicable only when a hospital is operated

13         by the hospital authority; providing an

14         effective date.

16  Be It Enacted by the Legislature of the State of Florida:

17

18         Section 1.  Subsection (10) of section 5 of chapter

19  96-449, Laws of Florida, is amended to read:

20         Section 5.  POWERS OF AUTHORITY.--The Authority

21  exercises a proper public purpose and essential governmental

22  function of the state and the county and shall have all power

23  and authority necessary to carry out the purposes of this act,

24  including, without limitation, all powers authorized by law to

25  hospital facilities, districts, and authorities and powers of

26  a body corporate, including the powers to:

27         (10)  Employ professional and other personnel necessary

28  to its effective operation, fix their compensation, and adopt

29  a personnel plan and, for each hospital operated by the

30  Authority, facilitate an employee advisory committee pursuant

31  to section 6 of this act.

  1         Section 2.  Subsection (2) of section 6 of chapter

  2  96-449, Laws of Florida, is amended to read:

  3         Section 6.  PERSONNEL.--

  4         (2)  For each hospital operated by the Authority, an

  5  employee advisory committee may be elected by employees from

  6  the facilities under the jurisdiction of the Authority in a

  7  manner determined by the Authority to assure representation

  8  from each facility. The employee advisory committee must meet

  9  at least quarterly. Suggestions by the employee advisory

10  committee relating to personnel matters must be considered by

11  the Authority. The employee advisory committee will be the

12  medium in providing a continuous and meaningful exchange

13  between the Authority and employees of ideas regarding and

14  practical solutions to personnel matters.

15         Section 3.  Subsection (3) of section 7 of chapter

16  96-449, Laws of Florida, is amended to read:

17         Section 7.  ADMISSIONS; INDIGENT CARE.--

18         (3)  When a resident of Hillsborough County has been

19  certified as indigent under criteria established by the Board

20  of County Commissioners of Hillsborough County, the Authority,

21  for each hospital which it operates, shall be reimbursed for

22  its services by Hillsborough County an amount equal to the

23  state-approved Medicaid rate plus a standard adjustment. The

24  Authority and the Board of County Commissioners shall, at

25  least once annually, negotiate the standard adjustment, which

26  shall include consideration of the actual cost of indigent

27  care when any such hospital is operational. Both the

28  reimbursement rate and the eligibility criteria shall be

29  reviewed and approved at least once annually by the Board of

30  County Commissioners, if any such hospital is operational.

  1         Section 4.  Section 9 of chapter 96-449, Laws of

  2  Florida, is amended to read:

  3         Section 9.  PARKING AND OFFICE FACILITIES.--Ad valorem

  4  taxes may not be used or pledged for revenue or for refunding

  5  bonds issued for the construction of parking facilities or

  6  private office facilities. For each hospital operated by the

  7  Authority, any office facility must be constructed on premises

  8  on or contiguous to the hospital grounds.

  9         Section 5.  This act shall take effect upon becoming a

10  law.
