1 A bill to be entitled
2 An act relating to solid waste management;
3 amending s. 403.706, F.S.; requiring the
4 Department of Environmental Protection to
5 conduct a comprehensive review of certain waste
6 reduction and recycling goals; providing that
7 the department must issue a report; amending s.
8 403.7095, F.S.; providing that the Department
9 of Environmental Protection may provide certain
10 counties with solid waste management and
11 recycling grants; deleting the provision that
12 these grants be limited to certain funding
13 received in fiscal year 1997-1998; requiring
14 the department to provide a specified amount
15 for recycling and waste-reduction grants
16 available to all counties on a competitive
17 basis for innovative programs; providing for
18 the expiration of the provision for innovative
19 grants; providing an effective date.

21 Be It Enacted by the Legislature of the State of Florida:
22
23 Section 1. Subsection (24) is added to section
24 403.706, Florida Statutes, to read:
25 403.706 Local government solid waste
26 responsibilities.--
27 (24) The department shall conduct a comprehensive
28 review of the waste reduction and recycling goals set out in
29 this section. The review shall include, but is not limited to,
30 the appropriateness of maintaining, extending, or revising the
31 goals; the effectiveness of current programs for meeting the

1 goals; the role of Keep Florida Beautiful, Inc.; the need to
2 continue those programs; alternative techniques for improving
3 those programs; and alternative strategies for meeting the
4 needs of the programs. The department shall consult with
5 persons knowledgeable about recycling and waste reduction,
6 including, but not limited to, representatives of local
7 government, the private recycling industry, and private waste
8 management industry. The department shall issue its report and
9 recommendations to the Governor, the President of the Senate,
10 and the Speaker of the House of Representatives by January 30,
11 2002.
12 Section 2. Subsections (8) and (9) of section
13 403.7095, Florida Statutes, are amended to read:
14 403.7095 Solid waste management grant program.--
15 (8) For fiscal year 2001-2002 2000-2001 only, the
16 department may shall provide counties with populations under
17 100,000 with at least 80 percent of the level of funding they
18 received in fiscal year 1997-1998 for solid waste management
19 and recycling grants. This subsection is repealed on July 1,
20 2001.
21 (9) For fiscal year 2000-2001 only, The department
22 shall provide $4.1 million 25 percent of the total funds
23 available after the requirements of subsection (8) are met for
24 recycling and waste reduction grants available to all counties
25 on a competitive basis for innovative programs. Because the
26 Legislature recognizes that input from the recycling industry
27 is essential to the success of this funding program, the
28 department shall cooperate with affected organizations to
29 develop a process and define specific criteria for evaluating
30 proposals and selecting programs for funding that comply with

1 the following general guidelines. Programs selected for
2 funding shall:
3 (a) Demonstrate technologies or processes that are not
4 in common use in Florida, that represent a novel application
5 of an existing technology or process, or that overcome
6 obstacles to recycling in new or innovative ways.
7 (b) Collect and recycle or reduce materials targeted
8 by the department and the recycling industry.
9 (c) Demonstrate the potential economic and
10 environmental benefits of the proposed recycling program and
11 the cost-effectiveness of the program's approach.
12 (d) Demonstrate transferability of technology and
13 processes used in the program and specify how the program will
14 promote transferability.
15 (e) Demonstrate local support for the proposed program
16 by the commitment of cash or in-kind matching funds.
17 (f) This subsection expires is repealed on July 1,
18 2002 2001.
19 Section 3. This act shall take effect July 1, 2001.

22 SENATE SUMMARY
23 Requires the Department of Environmental Protection to
conduct a comprehensive review of waste reduction and
24 recycling goals and report its recommendations to the
Governor and the Legislature. Authorizes the department
25 to provide solid waste management and recycling grants to
certain counties. Requires the department to provide a
26 specified sum of money for recycling and waste reduction
grants to all counties on a competitive basis.
