  1                      A bill to be entitled

  2         An act relating to Broward County; authorizing

  3         local governments in the county to grant an

  4         exception from the concurrency requirement for

  5         transportation facilities under s. 163.3180,

  6         F.S., for certain developments; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  In addition to the exceptions provided in

12  section 163.3180(5)(b), Florida Statutes, a local government

13  in Broward County may grant an exception from the concurrency

14  requirement for transportation facilities pursuant to said

15  section if the proposed development is otherwise consistent

16  with the adopted local government comprehensive plan, and is a

17  project that promotes public transportation or is located

18  within a Regional Activity Center as described in and defined

19  by the Broward County Comprehensive Plan, and is within an

20  area that contains major public and private postsecondary

21  institutions of higher learning.

22         Section 2.  This act shall take effect upon becoming a

23  law.
