13         Senate Amendment 
14         On page 14, lines 28-30, delete those lines
15  
16  and insert:  account balances and transactions; guidance,
17  advice, and allocation services directly relating to its own
18  investment options or products, but only if the bundled
19  provider complies with the standard of care of s.
20  404(a)(1)(A-B) of the Employee Retirement Income Security Act
21  of 1974 (ERISA) and if providing such guidance, advice, or
22  allocation services does not constitute a prohibited
23  transaction under s. 4975(c)(1) of the Internal Revenue Code
24  or s. 406 of ERISA, notwithstanding that such prohibited
25  transaction provisions do not apply to the optional retirement
26  program; a broad array of distribution options; asset
27  allocation; and retirement counseling and education. Private
