  1                      A bill to be entitled

  2         An act relating to solid waste management

  3         facilities; amending s. 403.707, F.S.;

  4         requiring an applicant for a permit to

  5         construct or modify such a facility to notify

  6         the local government of the filing of such

  7         application; requiring publication of notice of

  8         such filing; providing requirements with

  9         respect thereto; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Subsection (14) is added to section

14  403.707, Florida Statutes, to read:

15         403.707  Permits.--

16         (14)  Before or on the same day of filing an

17  application with the department for a permit to construct or

18  substantially modify a solid waste management facility, the

19  applicant shall notify the local government having

20  jurisdiction over the facility of the filing of the

21  application.  The applicant also shall publish notice of the

22  filing of the application in a newspaper of general

23  circulation in the area in which the facility will be located.

24  Notice shall be given and published in accordance with

25  applicable department rules.  The department shall not issue

26  the requested permit until the applicant has provided the

27  department with proof that the notices required by this

28  subsection have been given. Issuance of a permit does not

29  relieve an applicant from compliance with local zoning or land

30  use ordinances, or with any other law, rule, or ordinance.

31         Section 2.  This act shall take effect October 1, 2001.
