19 Section 1. Paragraph (nn) is added to subsection (1)
20 of section 458.331, Florida Statutes, to read:
21 458.331 Grounds for disciplinary action; action by the
22 board and department.--
23 (1) The following acts shall constitute grounds for
24 which the disciplinary actions specified in subsection (2) may
25 be taken:
26 (nn) Except as otherwise provided herein, delegating
27 ocular post-operative responsibilities to a person other than
28 an ophthalmologist licensed as a physician under this chapter
29 or chapter 459. Nothing herein shall be construed to prohibit
30 an ophthalmologist performing cataract surgery from delegating
31 ocular post-operative responsibilities relating to that

1 cataract surgery to a board certified optometrist licensed
2 under chapter 463 provided that the delegation occurs no
3 sooner than 14 days following cataract surgery, the board
4 certified optometrist is supervised by the operating surgeon
5 or an equivalently trained ophthalmologist, and the operating
6 surgeon remains responsible for the management of the
7 patient's post-operative care.
8 Section 2. Paragraph (pp) is added to subsection (1)
9 of section 459.015, Florida Statutes, to read:
10 459.015 Grounds for disciplinary action; action by the
11 board and department.--
