13         Senate Amendment (with title amendment) 
14         Delete everything after the enacting clause
15  
16  and insert:  
17         Section 1.  Paragraphs (nn) and (oo) are added to
18  subsection (1) of section 458.331, Florida Statutes, to read:
19         458.331  Grounds for disciplinary action; action by the
20  board and department.--
21         (1)  The following acts shall constitute grounds for
22  which the disciplinary actions specified in subsection (2) may
23  be taken:
24         (nn)  Delegating post-operative responsibilities to a
25  person not licensed as a physician under this chapter or
26  chapter 459, except where delegation to another licensed
27  health care practitioner is deemed medically appropriate by
28  the delegating physician and the other licensed health care
29  practitioner is required by law to conform to the same level
30  of care provided by medical practitioners in accordance with
31  the same or similar community standards. Such delegation shall

SENATE AMENDMENT Bill No. CS for SB 924 Amendment No. ___ Barcode 272574 1 be subject to the written informed consent of the patient, and 2 the post-operative care shall be performed pursuant to a 3 co-management protocol which requires regular reporting to the 4 surgeon and immediate consultation with a surgeon when the 5 care required by the patient exceeds the care which the other 6 licensed health care practitioner is authorized or trained to 7 perform. 8 (oo) Failing to report to the department any person 9 licensed under this chapter, chapter 459, or the chapter 10 regulating the alleged violator, whose failure to provide 11 appropriate post-operative care has caused a patient to 12 require emergency room treatment. 13 Section 2.
