15 On page 1, lines 17-29, delete those lines

17 and insert:
18 (nn) Except as otherwise provided herein, delegating
19 ocular post-operative responsibilities to a person other than
20 an ophthalmologist licensed as a physician under this chapter
21 or chapter 459. Nothing herein shall be construed to prohibit
22 an ophthalmologist performing cataract surgery from delegating
23 ocular post-operative responsibilities relating to that
24 cataract surgery to a board certified optometrist licensed
25 under chapter 463 provided that the delegation occurs no
26 sooner than 28 days following cataract surgery, the board
27 certified optometrist is supervised by the operating surgeon
28 or an equivalently trained ophthalmologist, and the operating
29 surgeon remains responsible for the management of the
30 patient's post-operative care.
31 Section 2. Paragraph (pp) is added to subsection (1)

1 of section 459.015, Florida Statutes, to read:
2 459.015 Grounds for disciplinary action; action by the
3 board and department.--
4 (1) The following acts shall constitute grounds for
5 which the disciplinary actions specified in subsection (2) may
6 be taken:
7 (pp) Except as otherwise provided herein, delegating
8 ocular post-operative responsibilities to a person other than
9 an ophthalmologist licensed as a physician under this chapter
10 or chapter 458. Nothing herein shall be construed to prohibit
11 an ophthalmologist performing cataract surgery from delegating
12 ocular post-operative responsibilities relating to that
13 cataract surgery to a board certified optometrist licensed
14 under chapter 463 provided that the delegation occurs no
15 sooner than 28 days following cataract surgery, the board
16 certified optometrist is supervised by the operating surgeon
17 or an equivalently trained ophthalmologist, and the operating
18 surgeon remains responsible for the management of the
