1 A bill to be entitled
2 An act relating to health care providers;
3 amending ss. 458.331, 459.015, F.S.; providing
4 an additional ground for discipline of persons
5 licensed under ch. 458, F.S., or ch. 459, F.S.;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Paragraph (nn) is added to subsection (1)
11 of section 458.331, Florida Statutes, to read:
12 458.331 Grounds for disciplinary action; action by the
13 board and department.--
14 (1) The following acts shall constitute grounds for
15 which the disciplinary actions specified in subsection (2) may
16 be taken:
17 (nn) Except as otherwise provided herein, delegating
18 ocular post-operative responsibilities to a person other than
19 an ophthalmologist licensed as a physician under this chapter
20 or chapter 459. Nothing herein shall be construed to prohibit
21 an ophthalmologist performing cataract surgery from delegating
22 ocular post-operative responsibilities relating to that
23 cataract surgery to a board certified optometrist licensed
24 under chapter 463 provided that the delegation occurs no
25 sooner than 28 days following cataract surgery, the board
26 certified optometrist is supervised by the operating surgeon
27 or an equivalently trained ophthalmologist, and the operating
28 surgeon remains responsible for the management of the
29 patient's post-operative care.
30 Section 2. Paragraph (pp) is added to subsection (1)
31 of section 459.015, Florida Statutes, to read:
