  1                      A bill to be entitled

  2         An act relating to the City of Jacksonville;

  3         amending chapter 92-341, Laws of Florida, as

  4         amended; clarifying exemptions provided in the

  5         Charter of the City of Jacksonville to the

  6         civil service status of designated positions;

  7         providing an effective date.

  8  

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsections (d), (f), (g), (y), and (z) of

12  section 17.06 of the charter of the City of Jacksonville, as

13  created by chapter 92-341, Laws of Florida, as amended, are

14  hereby amended to read:

16                    ARTICLE 17. CIVIL SERVICE

17         Section 17.06  Applicability of civil service system to

18  employees of consolidated government.--The civil service

19  provisions of this charter shall be applicable to all

20  employees of the consolidated government except:

21         (d) The following persons employed by the Duval County

22  School Board, provided that those persons holding these

23  positions on the effective date of this act shall continue

24  under the civil service system until removed in accordance

25  with the law and applicable civil service regulations:

26         (1)  Superintendent of schools, chief of staff,

27  regional deputy superintendents, associate and assistant

28  superintendents, chief information officer, administrative

29  assistants to the superintendent, directors, state or school

30  board issued certificated supervisors and coordinators,

  1  specialists in administrative or educational services, and

  2  secretary to superintendent.

  3         (2)  All persons employed in positions which are

  4  required under general state law and implementing regulations

  5  which apply uniformly throughout the state to be filled by

  6  persons holding a teacher's certificate.

  7         (3)  Teachers aides as defined by s. 231.141, Florida

  8  Statutes, or as they may hereafter be defined, and who are

  9  employed by the Duval County School Board.

10         (4)  Certified public accountants, and employees of the

11  Duval County School Board divisions of finance or business

12  affairs who are accountants holding a college degree or

13  equivalent certificate in accounting, unless otherwise

14  requested by such employee. Notwithstanding the provisions of

15  subsection (d), employees subject to this paragraph on the

16  effective date of this act may elect to discontinue their

17  civil service status, without prejudice to requesting

18  reinstatement at a later date.

19         (f)  Part-time and temporary employees who shall be

20  employed for a period of employment not to exceed 6 months.

21  The chief of personnel may authorize an extension of said 6

22  month employment period.

23         (g)  The executive director of the Commission on Human

24  Rights and the Director of Equal Opportunity/Equal Access

25  Community relations commission.

26         (y)  Assistant management improvement officers.

27         (z)  The director of libraries of the library board of

28  trustees, assistant director of libraries, and executive

29  assistants assistant of library services.

  1  Any person in the classified civil service who is appointed to

  2  a position exempted from the civil service system by this

  3  section shall be entitled to return to the same or a

  4  comparable civil service classification, with the same rights

  5  and status as held immediately prior to such appointment.

  6  Compensation for an employee returning to a civil service

  7  classification under this provision will be based upon the

  8  rate that he or she would have been receiving had the

  9  appointment not been made. This paragraph shall not apply to

10  employees exempted from civil service provisions by

11  subsections (a), (c), (e), (f), (i), or (q).

12         Section 2.  This act shall take effect upon becoming a

13  law.
