11 The Committee on Elder & Long-Term Care offered the following:

13 Amendment (with title amendment)
14 Remove from the bill: everything after the enacting clause,
15
16 and insert in lieu thereof:
17 Section 1. (1) The Legislature finds and declares
18 that it is the policy of this state not to interfere with an
19 employee's choice about whether to be represented by a labor
20 union. Furthermore, it is the policy of this state to ensure
21 that health care providers deliver quality care.
22 (2) Employee participation in any activity that
23 assists, promotes, deters, or discourages union organizing
24 shall not be allowed during any time the employee is counted
25 in staffing calculations.
26 (3) Salaries paid by any health care provider to an
27 employee for any activity that assists, promotes, deters, or
28 discourages union organizing shall not be an allowable cost
29 for Medicaid cost reporting purposes.
30 (4) Any expense, including, but not limited to, legal
31 and consulting fees and salaries of supervisors and employees,

1 incurred for activities directly relating to influencing
2 employees with respect to unionization shall not be an
3 allowable cost for Medicaid cost reporting purposes.
4 (5) This section does not apply to any activity
5 performed, or any expense incurred, in connection with:
6 (a) Addressing a grievance or negotiating or
7 administering a collective bargaining agreement.
8 (b) Performing an activity required by federal or
9 state law or by a collective bargaining agreement.
10 Section 2. This act shall take effect January 1, 2002.

15 On page 1, lines 2-11,
16 remove from the title of the bill: all of said lines,
17
18 and insert in lieu thereof:
19 An act relating to union organizing activities;
20 declaring certain state policies; prohibiting
21 employee participation in certain activities
22 for certain purposes; prohibiting certain
23 employee salaries and expenses as allowable
24 costs for certain purposes; specifying
25 nonapplication under certain circumstances;
26 providing an effective date.
