1 A bill to be entitled
2 An act relating to orthotics, prosthetics, and
3 pedorthics; amending s. 468.805, F.S.; revising
4 grandfathering requirements for licensure to
5 practice orthotics, prosthetics, or pedorthics
6 without meeting statutory educational
7 requirements; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsections (3) and (5) of section 468.805,
12 Florida Statutes, are amended to read:
13 468.805 Grandfathering.--
14 (3) An applicant who has received certification as an
15 orthotist, a prosthetist, a prosthetist-orthotist, or a
16 pedorthist from a national certifying body which requires the
17 successful completion of an examination, may be licensed under
18 this section without taking an additional examination. An
19 applicant who has not received certification from a national
20 certifying body which requires the successful completion of an
21 examination before March 1, 1998, shall be required to take an
22 examination as determined by the board. This examination shall
23 be designed to determine if the applicant has the minimum
24 qualifications needed to be licensed under this section, and
25 the board may not limit the number of times that an applicant
26 may sit for the examination. The applicant has until July 1,
27 2003, to complete the examination process. The board may
28 charge an examination fee and the actual per applicant cost to
29 the department for purchase or development of the examination.
30 (5) This section is repealed July 1, 2003 2002.

1 Section 2. This act shall take effect upon becoming a
2 law.

4 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
5 Senate Bill 962

7 The Committee Substitute revises grandfathering provisions in
s. 468.805(3), F.S., to extend the deadline from July 1, 2002,
8 to July 1, 2003, to allow certain applicants for licensure as
an orthotist, a prosthetist, a prosthetist-orthotist, or a
9 pedorthist who have not received certification from a
certifying body which requires successful completion of an
10 examination before March 1, 1998, to waive the education
requirements for licensure and to sit for the state licensure
11 examination. The bill provides the Board of Orthotists and
Prosthetists may not limit the number of times that an
12 applicant may sit for the examination. An applicant has until
July 1, 2003, to complete the examination process. To conform,
13 the repeal date of section 468.805, F.S., is extended from
July 1, 2002, to July 1, 2003.
