19 Section 1. Paragraphs (r) and (s) are added to
20 subsection (3) of section 408.036, Florida Statutes, Florida
21 Statutes, to read:
22 408.036 Projects subject to review.--
23 (3) EXEMPTIONS.--Upon request, the following projects
24 are subject to exemption from the provisions of subsection
25 (1):
26 (r) For the provision of adult open heart surgery
27 services in a hospital, the request for an exemption must
28 comply with the following criteria:
29 1. The hospital must have at least 390 licensed beds
30 as of the date of the exemption request.
31 2. The hospital shall demonstrate, for the twelve

1 month period ending one month prior to the date of the
2 exemption request, at least 400 admissions to the hospital
3 through its emergency room of patients with the primary
4 diagnosis of acute myocardial infarction, and the performance
5 of at least 1,000 diagnostic and therapeutic cardiac
6 catheterizations.
7 3. The hospital shall certify that its provision of
8 open heart surgery services will be offered in conjunction
9 with a therapeutic cardiac catheterization program, will be
10 available to all patients without regard as to ability to pay,
11 will maintain sufficient and appropriate equipment and staff
12 to ensure quality and safety, will be available 24 hours a
13 day, 7 days a week, and will maintain appropriate volumes as
14 reasonably necessary to ensure quality and safety.
15 4. The exemption shall terminate if the agency
16 determines that the hospital has failed to comply with the
17 certifications set forth in subparagraph 3. In the event the
18 exemption terminates, the hospital will not again be eligible
19 to apply for an exemption until two years following the date
20 of termination.
21 (s) For establishment of an adult open heart surgery
22 program through the transfer or relocation of an existing
23 adult open heart surgery program located at a hospital within
24 the same county, if such county is a county as defined by
25 section 125.011(1), which has a population that exceeds 1.5
26 million persons.
