16 and insert:
17 Section 6. Paragraph (c) of subsection (3) of section
18 373.139, Florida Statutes, is amended to read:
19 373.139 Acquisition of real property.--
20 (3) The initial 5-year work plan and any subsequent
21 modifications or additions thereto shall be adopted by each
22 water management district after a public hearing. Each water
23 management district shall provide at least 14 days' advance
24 notice of the hearing date and shall separately notify each
25 county commission within which a proposed work plan project or
26 project modification or addition is located of the hearing
27 date.
28 (c) The Secretary of Environmental Protection shall
29 release acquisition moneys from the appropriate account or
30 trust fund to a district following receipt of a resolution
31 adopted by the governing board identifying the lands being

1 acquired and certifying that such acquisition is consistent
2 with the 5-year work plan of acquisition and other provisions
3 of this section. The governing board also shall provide to the
4 Secretary of Environmental Protection a copy of all certified
5 appraisals used to determine the value of the land to be
6 purchased. In valuing lands for purposes of purchase or sale,
7 property appraisers may use any recognized appropriate
8 appraisal methodology, in compliance with the Uniform
9 Standards of Professional Appraisal Practice as defined in
10 chapter 475, including, but not limited to, the cost,
11 replacement value, and income approach. Each parcel to be
12 acquired must have at least one appraisal. Two appraisals are
13 required when the estimated value of the parcel exceeds
14 $500,000. However, when both appraisals exceed $500,000 and
15 differ significantly, a third appraisal may be obtained. If
16 the purchase price is greater than the appraisal price, the
17 governing board shall submit written justification for the
18 increased price. The Secretary of Environmental Protection
19 may withhold moneys for any purchase that is not consistent
20 with the 5-year plan or the intent of this section or that is
21 in excess of appraised value. The governing board may appeal
22 any denial to the Land and Water Adjudicatory Commission
23 pursuant to s. 373.114.
