15         On page 1, between lines 17 and 18,

17  insert:  
18         Section 1.  Paragraph (b) of subsection (3) of section
19  311.07, Florida Statutes, is amended to read:
20         311.07  Florida seaport transportation and economic
21  development funding.--
22         (3)
23         (b)  Projects eligible for funding by grants under the
24  program are limited to the following port facilities or port
25  transportation projects:
26         1.  Transportation facilities within the jurisdiction
27  of the port.
28         2.  The dredging or deepening of channels, turning
29  basins, or harbors.
30         3.  The construction or rehabilitation of wharves,
31  docks, structures, jetties, piers, storage facilities, cruise

The acquisition of container cranes or other 4 mechanized equipment used in the movement of cargo or 5 passengers in international commerce. 6 5. The acquisition of land to be used for port 7 purposes. 8 6. The acquisition, improvement, enlargement, or 9 extension of existing port facilities. 10 7. Environmental protection projects which are 11 necessary because of requirements imposed by a state agency as 12 a condition of a permit or other form of state approval; which 13 are necessary for environmental mitigation required as a 14 condition of a state, federal, or local environmental permit; 15 which are necessary for the acquisition of spoil disposal 16 sites and improvements to existing and future spoil sites; or 17 which result from the funding of eligible projects listed 18 herein. 19 8. Transportation facilities as defined in s. 20 334.03(31) which are not otherwise part of the Department of 21 Transportation's adopted work program. 22 9. Seaport intermodal access projects identified in 23 the 5-year Florida Seaport Mission Plan as provided in s. 24 311.09(3). 25 10. Construction or rehabilitation of port facilities 26 as defined in s. 315.02, excluding any park or recreational 27 facilities, in ports listed in s. 311.09(1) with operating 28 revenues of $5 million or less, provided that such projects 29 create economic development opportunities, capital 30 improvements, and positive financial returns to such ports. 31 11. SENATE AMENDMENT Bill No. SB 48-B Amendment No. ___ Barcode 251850 1 security infrastructure, technology, and the acquisition of 2 law enforcement personnel as contained in individual seaport 3 security plans required by s. 311.12. Seaport security 4 measures are not subject to the matching fund requirements of 5 paragraph (a). 6 Section 2. A new subsection (3) is added to section 7 311.12, Florida Statutes, and current subsections (3), (4), 8 (5), and (6) are renumbered as subsections (4), (5), (6) and 9 (7) respectively, to read: 10 311.12 Seaport security standards.-- 11 (3) Each security plan required by subsection (2) shall 12 contain a separate law enforcement security measure. The law 13 enforcement security measure shall identify law enforcement 14 personnel and other resource commitments, including the use or 15 organized militia under s. 250.06, necessary to respond to 16 attempted or actual terrorist activity, criminal activity or 17 other threats to the safety or unfettered operation of the 18 seaport. Qualified law enforcement personnel may include state 19 law enforcement personnel, local law enforcement personnel, 20 seaport security personnel, private sector security personnel, 21 or any combination of such law enforcement personnel. The 22 Department of Law Enforcement shall review and approve the law 23 enforcement security measure, and approve the use of qualified 24 law enforcement personnel. 25 Section 3. For the 2001-2002 state fiscal year only, 26 and notwithstanding the provisions of any other law to the 27 contrary, $5 million shall be made available from the Coastal 28 Protection Trust Fund to fund seaport security measures listed 29 in s. 311.07(3)(b)11.
