  1                      A bill to be entitled

  2         An act relating to solicitation of

  3         contributions; amending ss. 496.405, 496.409,

  4         496.410, and 496.419, F.S.; eliminating

  5         restrictions on the use of funds deposited into

  6         the General Inspection Trust Fund from

  7         registration fees and fines imposed under ch.

  8         496, F.S., relating to solicitation of

  9         contributions; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Paragraph (c) of subsection (4) of section

14  496.405, Florida Statutes, is amended to read:

15         496.405  Registration statements by charitable

16  organizations and sponsors.--

17         (4)

18         (c)  All registration fees must be paid to the

19  department and deposited into the General Inspection Trust

20  Fund to be used to pay the costs incurred in administering and

21  enforcing ss. 496.401-496.424.  Money deposited in the fund

22  and allocated for the purposes of ss. 496.401-496.424 must be

23  disbursed by the department for the funding of activities

24  conducted by the department pursuant to ss. 496.401-496.424,

25  inclusive.

26         Section 2.  Subsection (7) of section 496.409, Florida

27  Statutes, is amended to read:

28         496.409  Registration and duties of professional

29  fundraising consultant.--

30         (7)  All registration fees must be paid to the

31  department and deposited into the General Inspection Trust

  1  Fund to be used to pay the costs incurred in administering and

  2  enforcing ss. 496.401-496.424.  Money deposited in the fund

  3  and allocated for the purposes of ss. 496.401-496.424 shall be

  4  disbursed by the department for the funding of activities

  5  conducted by the department pursuant to ss. 496.401-496.424,

  6  inclusive.

  7         Section 3.  Subsection (15) of section 496.410, Florida

  8  Statutes, is amended to read:

  9         496.410  Registration and duties of professional

10  solicitors.--

11         (15)  All registration fees must be paid to the

12  department and deposited into the General Inspection Trust

13  Fund to be used to pay the costs incurred in administering and

14  enforcing ss. 496.401-496.424.  Money deposited in the fund

15  and allocated for the purposes of ss. 496.401-496.424 must be

16  disbursed by the department for the funding of activities

17  conducted by the department pursuant to ss. 496.401-496.424,

18  inclusive.

19         Section 4.  Subsection (9) of section 496.419, Florida

20  Statutes, is amended to read:

21         496.419  Powers of the department.--

22         (9)  All fines collected by the department under

23  subsection (5) must be paid into the General Inspection Trust

24  Fund to be used to pay the costs incurred in administering and

25  enforcing ss. 496.401-496.424 or s. 496.426.  Money deposited

26  in the fund and allocated for the purposes of ss.

27  496.401-496.424 or s. 496.426 must be disbursed by the

28  department for the funding of activities conducted by the

29  department pursuant to ss. 496.401-496.424 or s. 496.426,

30  inclusive.

  1         Section 5.  This act shall take effect upon becoming a

  2  law.
