1 A bill to be entitled
2 An act relating to the Florida Disaster
3 Volunteer Leave Act; amending s. 110.120, F.S.;
4 authorizing the Governor and Cabinet to approve
5 leave under the act for services in response to
6 a disaster occurring within the boundaries of
7 the United States; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 110.120, Florida Statutes, is
12 amended to read:
13 110.120 Administrative leave for disaster service
14 volunteers.--
15 (1) SHORT TITLE.--This section shall be known and may
16 be cited as the "Florida Disaster Volunteer Leave Act."
17 (2) DEFINITIONS.--As used in this section, the
18 following terms shall apply:
19 (a) "State agency" means any official, officer,
20 commission, board, authority, council, committee, or
21 department of the executive branch of state government.
22 (b) "Disaster" includes disasters designated at level
23 II and above in the American National Red Cross regulations
24 and procedures.
25 (3) LEAVE OF ABSENCE.--An employee of a state agency
26 who is a certified disaster service volunteer of the American
27 Red Cross may be granted a leave of absence with pay for not
28 more than 15 working days in any 12-month period to
29 participate in specialized disaster relief services for the
30 American Red Cross. Such leave of absence may be granted upon
31 the request of the American Red Cross and upon the approval of

1 the employee's employing agency. An employee granted leave
2 under this section shall not be deemed to be an employee of
3 the state for purposes of workers' compensation. Leave under
4 this act may shall be granted only for services related to a
5 disaster occurring within the boundaries of the State of
6 Florida, except that, with the approval of the Governor and
7 Cabinet, leave may be granted for services in response to a
8 disaster occurring within the boundaries of the United States.
9 Section 2. This act shall take effect upon becoming a
10 law.

13 SENATE SUMMARY
14 Authorizes the Governor and Cabinet to approve leave for
specified state employees who volunteer their services to
15 the American Red Cross for a disaster occurring within
the boundaries of the United States.
