18  available.  Beginning on January 1, 2002, the agency shall
19  limit the number of beds in participating Medicaid nursing
20  homes for which Medicaid reimbursement is available to the
21  number of Medicaid eligible residents for which Medicaid
22  payment is made on January 1, 2002.  The following are
23  exceptions to this Medicaid reimbursable bed limit: 
24  (a)  A nursing home is exempted from this limit if it is
25  located in a county that meets the definition of a county as
26  it is used in s. 395.602(2)(e)1., or s. 395.602(2)(e)2;
27  (b)  A nursing home with an occupancy rate below 70 percent
28  until it reaches an occupancy rate of 70 percent;
29  (c)  A resident of a nursing home that is admitted to a
30  facility with a payer other than Medicaid and converts to
31  Medicaid while in that facility may be paid for by Medicaid

 1  regardless of the facility's Medicaid bed cap; or
 2  (d)  A resident discharged to a hospital or the community may
 3  be readmitted to a facility within 30 days and be paid for by
 4  Medicaid regardless of the facility's Medicaid bed cap.
