  1                      A bill to be entitled

  2         An act relating to assignment of teachers and

  3         administrators to classroom duty; creating s.

  4         231.093, F.S.; prohibiting special assignment

  5         of instructional personnel that would remove

  6         such personnel from classroom teaching;

  7         providing an exception; providing for

  8         assignment of administrators to classroom duty

  9         under certain circumstances; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Section 231.093, Florida Statutes, is

15  created to read:

16         231.093  Assignment of teachers and administrators to

17  classroom duty.--

18         (1)  Notwithstanding any other provision of law, no

19  school principal, superintendent of schools, or district

20  school board shall assign or allow any instructional

21  personnel, as defined in s. 228.041(9), to serve on special

22  assignment that would have the effect of removing such

23  instructional personnel from classroom teaching. This

24  subsection does not apply to instructional personnel on

25  special assignment essential to receiving a federal or private

26  grant that provides the compensation and benefits for the

27  instructional personnel working on that assignment. The

28  provisions of this subsection shall not apply to persons

29  removed from the classroom and placed on special assignment

30  pursuant to s. 231.262(5).

  1         (2)  No school district shall employ a substitute

  2  teacher in any instance in which there is an assistant

  3  principal or a district-based instructional administrator who

  4  is qualified to perform that duty and who is not already

  5  teaching in the classroom. In any such instance, such

  6  qualified administrator shall be assigned to that classroom

  7  duty.

  8         (3)  This section shall not interfere with the

  9  operation of any provision of any contract entered into prior

10  to the effective date of this act.

11         Section 2.  This act shall take effect upon becoming a

12  law.
