1 A bill to be entitled
2 An act relating to displaced low-income
3 workers; authorizing the Department of Children
4 and Family Services to provide Medicaid
5 eligibility by rule to certain unemployed
6 persons; authorizing the state to provide a
7 COBRA insurance premium subsidy to certain
8 unemployed persons; providing for future
9 repeal; providing contingent effective dates.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. (1) The Department of Children and Family
14 Services may provide by rule that persons who become or became
15 unemployed after September 11, 2001, who are not eligible for
16 insurance coverage under the Consolidated Omnibus Budget
17 Reconciliation Act of 1985 (COBRA) shall be eligible for
18 Medicaid coverage.
19 (2) This section is repealed effective December 31,
20 2002.
21 (3) This section shall take effect on the effective
22 date of federal legislation authorizing the expansion of
23 Medicaid coverage to persons who become or became unemployed
24 after September 11, 2001, if such federal legislation provides
25 for enhanced federal Medicaid matching rates.
26 Section 2. (1) For persons who become or became
27 unemployed after September 11, 2001, who are eligible for
28 insurance coverage under the Consolidated Omnibus Budget
29 Reconciliation Act of 1985 (COBRA) but who are unable to
30 afford the premium, the state may subsidize up to 25 percent
31 of the premium.

1 (2) This section is repealed effective December 31,

3 (3) This section shall take effect on the effective

7 federal legislation provides for enhanced federal Medicaid

Effective on the effective date of federal enabling
13 legislation providing for enhanced federal Medicaid
matching rates, authorizes the Department of Children and
14 Family Services to provide Medicaid eligibility by rule
to persons who become or became unemployed after
15 September 11, 2001, and are ineligible for COBRA
insurance coverage. Effective on the effective date of
16 federal legislation providing a 75 percent premium
subsidy for persons eligible for COBRA coverage who
17 become or became unemployed after September 11, 2001, and
who are unable to afford the premium, authorizes a state
18 subsidy of up to 25 percent of the premium, if enhanced
federal Medicaid matching rates are provided. Provides
19 for future repeal.
