14 On page 1, between lines 23 and 24,

16 insert:
17 Section 2. Notwithstanding any other provision of law
18 to the contrary, the provisions of this section shall
19 supercede the proviso language with Specific Appropriation 570
20 in Senate Bill 2-C. The Correctional Privatization Commission
21 shall develop and issue requests for proposals (RFPs) for the
22 operation of each correctional facility prior to renewal of a
23 contract with the Correctional Privatization Commission. The
24 RFPs shall require that the per diem cost of operating each
25 correctional facility under contract with the Commission shall
26 not exceed 93 percent of the average per diem cost of housing
27 comparable prisoners within the Department of Corrections,
28 excluding those in the reception process and in community
29 correctional centers, for a cost savings of at least 7
30 percent. Any bids that do not reflect a cost savings to the
31 state of at least 7 percent shall be deemed to be

1 nonresponsive and must be rejected by the Commission.

3 It is the intent of the Legislature that the comparable per
4 diem of the Department of Corrections for the 2000-2001 fiscal
5 year shall be determined by the Office of Program Policy
6 Analysis and Governmental Accountability in consultation with
7 the Department of Corrections and the Auditor General. The
8 average per diem shall be adjusted for prospective inflation
9 and delivered to the commission.

11 The Department of Corrections shall assume operational
12 responsibility of any correctional facility for which there
13 are no proposals reflecting the 7 percent cost-savings
14 requirement. Current employees of private vendors operating
15 correctional facilities shall receive first preference for
16 employment by the Department of Corrections; provided,
17 however, that Correctional Officers currently employed by
18 private vendors must meet the minimum qualifications for
19 employment specific in section 943.13, Florida Statutes. In
20 accordance with the applicable provisions of chapter 216,
21 Florida Statutes, the Department of Corrections may request a
22 transfer from Specific Appropriations 696, 712, and 725 of
23 chapter 2001-235, Laws of Florida, to operate facilities for
24 which it has assumed operational responsibility.
