  1                      A bill to be entitled

  2         An act relating to municipal ordinances;

  3         ratifying certain municipal ordinances and

  4         certain procedures relating to such ordinances;

  5         declaring certain parking surcharges legal and

  6         valid; providing an effective date.

  7

  8         WHEREAS, the Legislature sought, by passage of section

  9  132, chapter 99-251, Laws of Florida, which created s.

10  218.503(5), Florida Statutes, to enact a general law

11  authorizing municipalities to impose parking surcharges under

12  circumstances of financial emergency and to specify the

13  purposes for which those surcharges may be expended, and

14         WHEREAS, the Legislature enacted Senate Bill 54B in the

15  2001 Special Session B to amend s. 218.503(5), Florida

16  Statutes, to authorize municipalities in a state of emergency

17  to impose a surcharge on the gross revenues of certain parking

18  facilities but did not clarify that the Legislature intended

19  that the use of proceeds collected and expended pursuant to

20  this section prior to the effective date of the amendment is

21  ratified, NOW, THEREFORE,

23  Be It Enacted by the Legislature of the State of Florida:

24

25         Section 1.  Any ordinance imposing a surcharge as

26  provided by s. 218.503(5), Florida Statutes, pursuant to s.

27  132, chapter 99-251, Laws of Florida, adopted by a

28  municipality is hereby ratified; all acts, proceedings, and

29  enforcement procedures taken in connection with a parking

30  surcharge imposed by such ordinance are ratified, validated,

31  and confirmed; and the surcharge is declared to be legal and

  1  valid in all respects from the effective date of such

  2  ordinance.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.
