2 An act relating to capitol security; creating
3 s. 281.401, F.S.; creating the Capitol Complex
4 Security Commission; providing for membership;
5 defining the term "capitol complex"; providing
6 for powers and duties; providing for the
7 application of rules adopted by the commission
8 which are in conflict with chapter 281, F.S.;
9 relieving the Department of Management Services
10 of certain responsibilities; providing an
11 appropriation; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Section 281.401, Florida Statutes, is
16 created to read:
17 281.401 Capitol Complex Security Commission; creation;
18 powers and duties.--
19 (1) There is hereby created the Capitol Complex
20 Security Commission. The commission shall consist of the
21 Governor, the President of the Senate, the Speaker of the
22 House of Representatives, the Chief Justice of the Supreme
23 Court, and the Cabinet. The commission shall be chaired by the
24 Governor, if present, then by the President of the Senate if
25 the Governor is not present, then by the Speaker of the House
26 of Representatives if the Governor and the President of the
27 Senate are not present, then by the Chief Justice of the
28 Supreme Court if the Governor, the President of the Senate,
29 and the Speaker of the House of Representatives are not
30 present, then by the senior Cabinet member in order of
31 succession if the Governor, the President of the Senate, the

1 Speaker of the House of Representatives, and the Chief Justice
2 of the Supreme Court are not present. For voting purposes,
3 each member of the commission may appoint a designee to
4 represent the commission member at meetings.
5 (2) For the purposes of this section, the term
6 "capitol complex" means the Capitol, the Senate Office
7 Building, the House Office Building, the Knott Building, the
8 Pepper Building, the Holland Building, the Supreme Court
9 Building, the Historic Capitol, and state-owned lands adjacent
10 thereto.
11 (3) The commission shall develop and propose a
12 comprehensive and ongoing plan for the safety and security of
13 the capitol complex. The commission shall adopt rules,
14 policies, procedures, and operational plans to maintain a
15 reasonable degree of safety and security while assuring
16 reasonable access to buildings and premises within the capitol
17 complex by state officials, employees, and visitors. Such plan
18 and initial rules shall be adopted on or before February 8,
19 2002.
20 (4) The commission may employ an executive director,
21 may employ officers and guards, and may contract with law
22 enforcement agencies and private security firms to provide
23 security and law enforcement services. Sworn officers employed
24 by the commission shall have the authority to bear arms, make
25 arrests, and apply for arrest warrants, provided that all such
26 officers hold certification as law enforcement officers in
27 accordance with the minimum standards and qualifications set
28 forth in s. 943.13 and with the provisions of chapter 110, and
29 any persons employed by the commission who are not certified
30 law enforcement officers shall not be authorized to bear arms
31 or make arrests.

1 (5) To the extent that any rules adopted by the
2 commission are contrary to any other provisions of this
3 chapter, the rules of the commission shall prevail. The
4 Department of Management Services is hereby relieved of
5 responsibility for any area that is expressly assumed by the
6 commission by rule pursuant to this section.
7 (6) The commission shall be housed in the Executive
8 Office of the Governor.
9 Section 2. There is hereby appropriated from the
10 General Revenue Fund to the Executive Office of the Governor
11 an amount sufficient to carry out the provisions of this act.
12 Section 3. This act shall take effect upon becoming a
13 law.
