2 An act relating to public school funding;
3 authorizing equalized nonvoted capital
4 improvement millage to be expended for
5 operations in fiscal year 2001-2002; providing
6 for the use of other funds; providing an
7 appropriation; providing for repeal; providing
8 an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. (1)(a) To help mitigate the impact of the
13 midyear reduction in the 2001-2002 fiscal year appropriation
14 for the Florida Education Finance Program, each district
15 school board is authorized to expend in its operating budget
16 as nonrecurring funds up to 0.5 mills of its nonvoted capital
17 improvement millage levied pursuant to s. 236.25(2), Florida
18 Statutes, for the 2001-2002 fiscal year, that will produce an
19 amount not to exceed $125 per full-time equivalent student.
20 This authorized use of proceeds from this millage levy is in
21 addition to the authorized uses set forth in s. 236.25,
22 Florida Statutes, and is for the 2001-2002 fiscal year only.
23 Any proceeds from this millage levy used to replace the
24 midyear budget reduction in the Florida Education Finance
25 Program shall be transferred by budget amendment approved by
26 the district school board at a regular meeting of the school
27 board.
28 (b) If the proceeds from 0.5 mills produce less than
29 $125 per full-time equivalent student in any school district,
30 the additional amount required to equal $125 per full-time
31 equivalent student shall be provided from state funds.

1 (c) If a district school board has not levied
2 sufficient millage pursuant to s. 236.25(2), Florida Statutes,
3 for the 2001-2002 fiscal year to produce $125 per full-time
4 equivalent student and the school board has other similar
5 funds available, the school board may use such funds in lieu
6 of proceeds from millage.
7 (d) There is hereby appropriated the sum of
8 $15,114,077 from unbudgeted educational enhancement trust
9 funds to provide equalized $125 per full-time equivalent
10 student as provided in (1)(b).
11 (2) This section is repealed effective June 30, 2002.
12 Section 2. This act shall take effect upon becoming a
13 law.
