1 A bill to be entitled
2 An act relating to Broward County; requiring
3 that licenses and permits for surface water
4 management activities issued by any special
5 district or municipality in Broward County be
6 renewed or recertified every 5 years to ensure
7 design level water quality treatment and flood
8 protection; providing that existing licenses
9 and permits that exceed a 5-year period be
10 brought into compliance within a 6-year period;
11 exempting the South Florida Water Management
12 District from the provisions of the act;
13 defining "special district" for purposes of the
14 act; providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. (1)(a) Notwithstanding any other law to
19 the contrary, any license or permit for surface water
20 management activities issued by any special district, or any
21 municipality or portion thereof, that is located solely within
22 the boundaries of Broward County shall be renewed or
23 recertified every 5 years. The renewal or recertification
24 shall ensure that the facility for which the license or permit
25 was issued has been maintained in such a way as to meet the
26 level of water quality treatment and flood protection of the
27 original design. Special districts shall have 6 years from the
28 effective date of this act to bring into compliance any
29 existing licenses or permits that have been issued,
30 recertified, or renewed for a period exceeding 5 years.

1 (b) The provisions of this act shall not apply to the
2 South Florida Water Management District.
3 (2) For purposes of this act, "special district" means
4 a district created under, subject to, or otherwise operating
5 pursuant to the provisions of chapter 189, chapter 190, or
6 chapter 298, Florida Statutes, that exercises any general or
7 special powers to license or permit surface water management
8 activities, including authorizing, licensing, or permitting
9 the construction, renovation, or improvement of water
10 management facilities, water control, flood protection, water
11 quantity management, or water quality protection or
12 improvement, or issuing, renewing, or recertifying licenses or
13 permits for any water management activities.
14 Section 2. This act shall take effect upon becoming a
15 law.
