13         Amendment to Amendment (833993) (with title amendment) 

14         On page 32, between lines 11 & 12 of the amendment

15

16  insert:

17         Section 17.  Section 713.265, Florida Statutes, is

18  created to read:

19         713.265  Required proof of workers' compensation

20  insurance coverage.--On any commercial building project, as

21  defined in s. 440.02, which is valued at $250,000 or greater,

22  no action for labor or materials or supplies may be instituted

23  or prosecuted against the owner, contractor, or surety, and no

24  lien shall attach to the land, unless the lienor or claimant

25  required to serve a notice to owner or notice to contractor

26  pursuant to s. 713.06(2) or s. 713.23(1)(c) serves to all

27  required recipients concurrently with said notice a

28  certificate of insurance issued by the carrier demonstrating

29  that the lienor or claimant has secured workers' compensation

30  insurance coverage for its employees under chapter 440.

31         Section 18.  Subsection (10) is added to section

  1  255.05, Florida Statutes, to read:

  2         255.05  Bond of contractor constructing public

  3  buildings; form; action by materialmen.--

  4         (10)  On any public works project for which the public

  5  authority requires a performance and payment bond, and which

  6  is valued at $250,000 or greater, no action for labor or

  7  materials or supplies may be instituted or prosecuted against

  8  the contractor or surety unless the claimant required to serve

  9  the contractor with notice of his or her intent to look to the

10  bond for protection pursuant to sub-sub-paragraph (2)(a)2.

11  serves to all required recipients concurrently with said

12  notice a certificate of insurance issued by the carrier

13  demonstrating that the claimant has secured workers'

14  compensation insurance coverage for its employees under

15  chapter 440.
