1 A bill to be entitled
2 An act relating to enterprise zones;
3 authorizing certain counties to apply for
4 amendment of enterprise zone boundary lines;
5 providing deadlines; prescribing conditions
6 applicable to the areas proposed for addition
7 to the enterprise zones; directing the Office
8 of Tourism, Trade, and Economic Development to
9 approve such amendments under certain
10 conditions; providing for application of this
11 act; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Notwithstanding any provisions in section
16 290.0055, Florida Statutes, regarding the size of an
17 enterprise zone, a county as defined in section 125.011(1),
18 Florida Statutes, may apply to the Office of Tourism, Trade,
19 and Economic Development before October 1, 2002, to amend the
20 boundary lines of its existing enterprise zone in order to add
21 an area not exceeding 4 square miles. The area proposed for
22 addition to the enterprise zone under this section must be
23 contiguous to a portion of the existing enterprise zone and
24 must be part of a revitalization area that has been targeted
25 for assistance by the county or by a municipality within the
26 county. The area proposed for addition to the enterprise zone
27 also must contain a high concentration of individuals who have
28 immigrated to this state from Haiti. The Office of Tourism,
29 Trade, and Economic Development shall approve an amendment to
30 the enterprise zone boundary lines, effective January 1, 2003,
31 provided that the area proposed for addition to the enterprise

1 zone is consistent with the criteria and conditions imposed by
2 section 290.0055, Florida Statutes, upon the establishment of
3 enterprise zones, including the requirement that the area
4 suffer from pervasive poverty, unemployment, and general
5 distress.
6 Section 2. Notwithstanding any provisions in section
7 290.0055, Florida Statutes, regarding the size of an
8 enterprise zone, a county as defined in section 125.011(1),
9 Florida Statutes, may apply to the Office of Tourism, Trade,
10 and Economic Development before October 1, 2002, to amend the
11 boundary lines of its existing enterprise zone in order to add
12 an area not exceeding 4 square miles. The area proposed for
13 addition to the enterprise zone under this section must be
14 contiguous to a portion of the existing enterprise zone and
15 must be part of a revitalization area that has been targeted
16 for assistance by a commission authorized in section 163.06,
17 Florida Statutes. The Office of Tourism, Trade, and Economic
18 Development shall approve an amendment to the enterprise zone
19 boundary lines, effective January 1, 2003, provided that the
20 area proposed for addition to the enterprise zone is
21 consistent with the criteria and conditions imposed by section
22 290.0055, Florida Statutes, upon the establishment of
23 enterprise zones, including the requirement that the area
24 suffer from pervasive poverty, unemployment, and general
25 distress. The area proposed for addition to the enterprise
26 zone under this section may not include any property used for
27 the benefit of a professional sports franchise. Any portion of
28 the area designated under this section by the Office of
29 Tourism, Trade, and Economic Development as an addition to an
30 enterprise zone shall automatically lose its status as part of
31 an enterprise zone if such portion subsequently includes

1 property used for the benefit of a professional sports
2 franchise.
3 Section 3. Sections of this act authorizing a county
4 as defined in section 125.011(1), Florida Statutes, to amend
5 and expand the boundary lines of an existing enterprise zone
6 are not mutually exclusive.
7 Section 4. This act shall take effect upon becoming a
8 law.

10 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
11 Senate Bill 1088

13 The committee substitute increases the size of the area that
includes a high concentration of Haitian immigrants that may
14 be designated as an addition to the Miami-Dade County
enterprise zone from three to four square miles. The committee
15 substitute further authorizes an amendment expanding the
Miami-Dade County enterprise zone to include an area targeted
16 for revitalization by the Miami River Commission.
