14         On page 17, line 29, delete that line

15

16  and insert:  considered late, unless, in the opinion of the

17  division or the board, exceptional circumstances beyond an

18  employer's control prevented remittance by the prescribed due

19  date notwithstanding the employer's good-faith efforts to

20  effect delivery. A waiver of delinquency by the division or

21  the board may be granted an employer only one time each fiscal

22  year. The employer shall be assessed a penalty of 1
