14 On page 43, between lines 14 and 15,

16 insert:
17 Section 8. (1) Notwithstanding section 409.911,
18 Florida Statutes, for the state fiscal year 2002-2003 only,
19 the Agency for Health Care Administration shall distribute
20 moneys under the regular disproportionate share program only
21 to public hospitals. Public hospitals are defined as those
22 hospitals included in the agency's calculation of the Medicaid
23 Upper Payment Limit in accordance with 42 C.F.R. 447.272. The
24 following methodology shall be used to distribute
25 disproportionate share dollars to the public hospitals:

27 For nonstate government-owned or operated hospitals:

29 DSHP = [(.9*HCCD)+(.1*HMD)/(CCD+TMD)]*TAAPH

9 DSHP = disproportionate share hospital payments.
10 HMD = hospital Medicaid days.
11 TMD = total state Medicaid days for public hospital.
12 HCCD = hospital charity care days.
13 TCCD = total state charity care days for public
14 hospitals.

16 (2) Notwithstanding section 409.9112, Florida
17 Statutes, for state fiscal year 2002-2003 only,
18 disproportionate share payments to regional perinatal
19 intensive care centers shall be equal to the disproportionate
20 payments made to the regional perinatal intensive care centers
21 in state fiscal year 2001-2002.
22 (3) Notwithstanding section 409.9117, Florida
23 Statutes, for state fiscal year 2002-2003 only,
24 disproportionate share payments to hospitals that qualify for
25 primary care disproportionate payments shall be equal to the
26 primary care disproportionate payments made to those hospitals
27 in state fiscal year 2001-2002.
28 (4) For state fiscal year 2002-2003 only, no
29 disproportionate share payments shall be made to hospitals
30 under the provisions of section 409.9119, Florida Statutes.
31 (5) In the event the Centers for Medicare and Medicaid

1 Services does not approve Florida's inpatient hospital state
2 plan amendment for the public disproportionate share program
3 by November 1, 2002, the agency may make payments to hospitals
4 under the regular disproportionate share program, regional
5 perinatal intensive care centers disproportionate share
6 program, primary care disproportionate share program, and
7 children's disproportionate share program using the same
8 methodologies used in state fiscal year 2001-2002.
9 (6) This section expires July 1, 2003.
