  1                      A bill to be entitled

  2         An act relating to the designation of

  3         transportation facilities; creating s. 335.081,

  4         F.S.; providing limitations on the duty of the

  5         Department of Transportation to erect signage

  6         relating to road designations and bridge

  7         designations made by the Legislature; repealing

  8         s. 334.071, F.S., relating to legislative

  9         designations of transportation facilities;

10         providing requirements for requests to

11         establish road and bridge designations and

12         redesignations; providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15

16         Section 1.  Section 335.081, Florida Statutes, is

17  created to read:

18         335.081  Requirements for requests for road or bridge

19  designations.--

20         (1)  When the Legislature establishes a road

21  designation or a bridge designation, the department must place

22  markers only at the termini specified for each highway segment

23  or bridge designated by the law creating the designation. The

24  department may place other markers as appropriate for the

25  transportation facility that has been designated. These

26  designations are for honorary or memorial purposes or to

27  distinguish a particular facility and do not require a local

28  government or private party to change any street sign, mailing

29  address, or listing in a 911 system or other

30  emergency-telephone-number system.

  1         (2)  The Legislature may not consider establishing a

  2  road or bridge designation that names a person unless the

  3  person has been deceased for at least 2 years with the

  4  exception of roads or bridges located:

  5         (a)  Within a municipality if the designation has been

  6  approved by resolution of the governing body of the

  7  municipality;

  8         (b)  Within an unincorporated area if the designation

  9  has been approved by resolution of the board of county

10  commissioners; or

11         (c)  Within more than one local jurisdiction if the

12  designation has been approved by resolution of the governing

13  boards of each affected jurisdiction.

14         (3)  A road or bridge that has previously been

15  designated may not be redesignated unless the road or bridge

16  is located:

17         (a)1.  Within a municipality if the designation has

18  been approved by resolution of the governing board of the

19  municipality;

20         2.  Within an unincorporated area if the designation

21  has been approved by resolution of the board of county

22  commissioners; or

23         3.  Within more than one local jurisdiction if the

24  designation has been approved by resolution of the governing

25  board of each affected jurisdiction; and

26         (b)  The previous designation is removed.

27         Section 2.  Section 334.071, Florida Statutes, is

28  repealed.

29         Section 3.  This act shall take effect upon becoming a

30  law.
