11  Senator Garcia moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 26, line 22, through page 27, line 13, delete

15  those lines

16

17  and insert:  charges that are adjudged against the protestor

18  in the administrative hearing in which the action is brought

19  and in any subsequent appellate court proceeding. In lieu of a

20  bond, the department, the water management district, or state

21  agency may, in either case, accept a cashier's check, official

22  bank check, or money order in the amount of the bond. If,

23  after completion of the administrative hearing process and any

24  appellate court proceedings, the department, water management

25  district, or agency prevails, it shall recover all costs and

26  charges which shall be included in the final order or

27  judgment, excluding attorney's fees. This section shall not

28  apply to protests filed by the Office of Supplier Diversity.

29  Upon payment of such costs and charges by the protestor person

30  protesting the award, the bond, cashier's check, official bank

31  check, or money order shall be returned to the protestor him
