14 On page 83, between lines 14 and 15,

16 insert:
17 Section 40. Effective January 7, 2003, all powers,
18 duties, functions, rules, records, personnel, property, and
19 unexpended balances of appropriations, allocations, or other
20 funds of the Correctional Privatization Commission, as created
21 in chapter 957, Florida Statutes, are transferred to the
22 office of the chief financial officer by a type one transfer,
23 as defined in section 20.06(2), Florida Statutes.
24 Section 41. Subsection (1), paragraph (e) of
25 subsection (3), and subsection (6) of section 957.03, Florida
26 Statutes, are amended to read:
27 957.03 Correctional Privatization Commission.--
28 (1) COMMISSION.--The Correctional Privatization
29 Commission is created within the office of the chief financial
30 officer for the purpose of entering into contracts with
31 contractors for the designing, financing, acquiring, leasing,

1 constructing, and operating of private correctional
2 facilities. For administrative purposes, the commission is
3 created within the Department of Management Services. The
4 commission may enter into contracts with contractors for the
5 designing, financing, acquiring, leasing, and constructing of
6 private juvenile commitment facilities.
7 (3) TERMS, ORGANIZATION, AND MEETINGS.--
8 (e) The commission may employ an executive director,
9 subject to approval or dismissal by the chief financial
10 officer, and such staff as is necessary, within the limits of
11 legislative appropriation. The commission may retain such
12 consultants as it deems necessary to accomplish its mission.
13 Neither the executive director nor any consultant retained by
14 the commission may have been an employee or a contract vendor
15 of or a consultant to the department or the Department of
16 Juvenile Justice, or an employee or a contract vendor of or a
17 consultant to a bidder, for 2 years prior to employment with
18 the commission and may not become an employee or a contract
19 vendor of or a consultant to the department or the Department
20 of Juvenile Justice, or an employee or a contract vendor of or
21 a consultant to a bidder, for 2 years following termination of
22 employment with the commission.
23 (6) OFFICE OF THE CHIEF FINANCIAL OFFICER SUPPORT BY
24 DEPARTMENT OF MANAGEMENT SERVICES.--The commission shall be a
25 separate budget entity, and the executive director shall be
26 its chief administrative officer. The office of the chief
27 financial officer Department of Management Services shall
28 provide administrative support, oversight, and service to the
29 commission to the extent requested by the executive director.
30 The commission and its staff are not subject to control,
31 supervision, or direction by the Department of Management

1 Services in any manner, including, but not limited to,
2 personnel, purchasing, and budgetary matters, except to the
3 extent as provided in chapters 110, 216, 255, 282, and 287 for
4 agencies of the executive branch. The executive director may
5 designate a maximum of two policymaking or managerial
6 positions as being exempt from the Career Service System.
7 These two positions may be provided for as members of the
8 Senior Management Service.
