13         Senate Amendment 

14         On page 49, lines 1-12, delete those lines

15

16  and insert:

17         (e)  Refer to the agency all suspected abusive

18  activities not of a criminal or fraudulent nature.

19         (f)  Refer to the agency for collection each instance

20  of overpayment to a provider of health care under the Medicaid

21  program which is discovered during the course of an

22  investigation.

23         (f)(g)  Safeguard the privacy rights of all individuals

24  and provide safeguards to prevent the use of patient medical

25  records for any reason beyond the scope of a specific

26  investigation for fraud or abuse, or both, without the

27  patient's written consent.

28         (g)  Publicize to state employees and the public the
