2 An act relating to reporting requirements of
3 committees of continuous existence; amending s.
4 106.04, F.S.; requiring membership dues of
5 committees of continuous existence to be
6 reported in the same manner as regular
7 contributions; creating exemptions; providing
8 penalties; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Paragraph (c) of subsection (4) of section
13 106.04, Florida Statutes, is amended to read:
14 106.04 Committees of continuous existence.--
15 (4)
16 (c) All committees of continuous existence shall file
17 the original and one copy of their reports with the Division
18 of Elections. In addition, a duplicate copy of each report
19 shall be filed with the supervisor of elections in the county
20 in which the committee maintains its books and records, except
21 that if the filing officer to whom the committee is required
22 to report is located in the same county as the supervisor no
23 such duplicate report is required to be filed with the
24 supervisor. Reports shall be on forms provided by the
25 division and shall contain the following information:
26 1. The full name, address, and occupation of each
27 person who has made one or more contributions, including
28 contributions which represent the payment of membership dues,
29 to the committee during the reporting period, together with
30 the amounts and dates of such contributions. For
31 corporations, the report must provide as clear a description

1 as practicable of the principal type of business conducted by
2 the corporation. However, if the contribution is $100 or
3 less, the occupation of the contributor or principal type of
4 business need not be listed. However, for any contributions
5 which represent the regular payment of dues by members in a
6 fixed amount no more than $50 per payment and not exceeding
7 $250 per calendar year pursuant to the schedule on file with
8 the Division of Elections, only the aggregate amount of such
9 contributions need be listed, together with the number of
10 members paying such dues and the amount of the membership
11 dues.
12 2. The name and address of each political committee or
13 committee of continuous existence from which the reporting
14 committee received, or the name and address of each political
15 committee, committee of continuous existence, or political
16 party to which it made, any transfer of funds, together with
17 the amounts and dates of all transfers.
18 3. Any other receipt of funds not listed pursuant to
19 subparagraph 1. or subparagraph 2., including the sources and
20 amounts of all such funds.
21 4. The name and address of, and office sought by, each
22 candidate to whom the committee has made a contribution during
23 the reporting period, together with the amount and date of
24 each contribution.
25 (d) The treasurer of each committee shall certify as
26 to the correctness of each report and shall bear the
27 responsibility for its accuracy and veracity. Any treasurer
28 who willfully certifies to the correctness of a report while
29 knowing that such report is incorrect, false, or incomplete
30 commits a misdemeanor of the first degree, punishable as
31 provided in s. 775.082 or s. 775.083.

1 Section 2. This act shall take effect July 1, 2002.

3 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
4 Senate Bill 1192

6 The committee substitute differs from the original bill in
that it: allows lump-sum reporting of regular payments of
7 membership dues provided each payment is $50 or less and does
not exceed $250 per calendar year, pursuant to a fixed
8 schedule on file with the Division of Elections; and, changes
the effective date of the bill from "upon becoming law" to
9 July 1, 2002.
