11  The Committee on Judicial Oversight offered the following:

13         Amendment (with title amendment) 
14  Remove everything after the enacting clause
15
16  and insert:
17         Section 1.  Section 960.0021, Florida Statutes, is
18  created to read:
19         960.0021  Legislative intent; advisement to victims.--
20         (1)  The Legislature finds that in order to ensure that
21  crime victims can effectively understand and exercise their
22  rights, and in order to promote law enforcement that considers
23  the interests of crime victims, victims must be properly
24  advised in the courts of this state.
25         (2)  Any judge who presides over a criminal docket at
26  which accused persons are arraigned or sentenced, or when
27  cases are considered for case management, shall announce the
28  following advisement:

30         If you are the victim of a crime with a case
31         pending before this court, you are advised that

  1         you have the right:
  2              (1)  To be informed.
  3              (2)  To be present.
  4              (3)  To be heard, when relevant, at all
  5         crucial stages of criminal proceedings to the
  6         extent that these rights do not interfere with
  7         the constitutional rights of the accused.
  8              (4)  To receive advance notification, when
  9         possible, of judicial proceedings and
10         notification of scheduling changes.
11              (5)  To seek crimes compensation and
12         restitution.
13              (6)  To consult with the state attorney's
14         office in certain felony cases regarding the
15         disposition of the case.
16              (7)  To make an oral or written
17         victim-impact statement at the time of
18         sentencing of a defendant.

20         For further information regarding additional
21         rights afforded to victims of crime, you may
22         contact the state attorney's office or obtain a
23         listing of your rights from the Clerk of Court.
24
25         (3)  This section is only for the benefit of crime
26  victims.  Accordingly, a failure to comply with this section
27  shall not affect the validity of any hearing, conviction, or
28  sentence.
29         Section 2.  This act shall take effect upon becoming a
30  law.
